Ruth Lauer President of League of Women Voters
Lloyd Croslin, a friend and supporter of WPS
Carolyn Jordan, attorney in Family Law
On January 28, the WPS made a request for Contingency Funding for operational
purposes as recommended by the CDAC; the item died for lack of a second.
They once again appear making the same request as recommended by the CDAC
and the fund requested is $11,600.; this is a lesser amount because they
have received $4,400. in donations. This is a one -time -only request and the
purpose is to pay the salary of the executive director through November 14,
1982.
On Wednesday, April 21, the United Way did approve their agency for funding
in the 1982-83 year. The various persons listed above appeared on behalf of
WPS reciting that previous Councils had approved short-term or one -time -only
funding for new agencies providing a service to the community in order to
assist them in establishing a track record and to become solvent. They
again emphasized this was a one -time -only basis.
The motion was made by Councilman Aderton, seconded by Mayor Pro Tem Henry
to approve the requested funding in the amount of $11,600. from C.D. Contingency
Funds on the basis and assurance that this would be a one -time -only request.
Motion carried; 3 Yeas; with Councilman Brown and Councilwoman Baker voting

Proponent: Jim Hall on behalf of Harmon Paint Co.
This request is for the Harmon Tank Co. to expand at its present site which
is currently zoned C-4 Heavy Commercial. Adjacent land uses are vacant
R-1 Single Family on the north and east, C-4 Heavy Commercial on the south,
and M-1 zoning on the west.
The land immediately north and east of this tract has remained vacant and it
is the opinion of the P&Z Commission and staff that these tracts will not
develop into R-1 Single Family uses. A discussion at the P&Z hearing
indicated that a solid screen fence should be erected on the southwest
corner of 10th and Ute, however, the P&Z Commission felt that a cyclone
fence along 10th and along Ute up to the north right-of-way line on east
Main would be satisfactory and would keep traffic from entering off of 10th
or Ute. This condition as stipulated by P&Z was agreeable to proponent.

The basis of this request of changing the site from C-4 to C-4 prohibiting
dance halls, night clubs, bars or lounges is the outgrowth of a variance
granted by the ZBA in 1973. The property has been zoned as C-4 Heavy
Commercial for many years. When first zoned C-4, bars and lounges were
not permitted by the zoning ordinance. In 1972, liquor by the dink was
approved by the voters and bars and lounges were classified as C-r4. However,
in the then existing zone ordinance, bars are required to maintain a 200'
separation from any residentially zoned property.
1000 APR 2
In 1973, the ZBA granted a variance of the 2001 separation primarily because
there was already a BYOB Club on site and ZBA assumed there would be no
greater burden on the adjacent area. By granting this variance, ZBA
unintentionally granted an open ended right for the club to occupy the
existing building or to expand.
In 1975, the Zoning Ordinance changed the parking requirements required
for clubs. In December, 1980, the existing building burned and in 1981
a building permit was issued to rebuild. On appeal from the building
official's ruling to allow the building permit, the ZBA overturned the
building official's decision and ruled that the building permit should not have
been issued. This matter is now on appeal in the District Court by Graham
and Associates.

site, the zoning standards for set -backs, off-street
and landscaping would need to be met. Adjacent land
The comprehensive plan recommends maintaining proper buffers between low
density residential and commercial uses. There is only an alley
separating a residential use from the heavy commercial use. There have
been continuous complaints from adjacent residencies regarding the
blocking of driveways, damage to property, loud and abusive language in
the early hours of the morning and there has been considerable spill-
over parking problems, congestion on 19th Street during the activities
at the club until 2:00 a.m. with said club having a late hours permit.
Apparently throughout the years, managers of the club have been unable
to control this element of activity outside the club building.
Mr. Casell gave a brief history of the ownership under Graham and Associates,
their purchasing three pieces of property authorized by the City in
1979; that the corporation has suffered extensive losses since December
of 1980 when the facility burned; that Mr. Lester Shafer is the owner of
the building and that the matter is now in the Courts regarding the ZBA
ruling. Mr. Caswell further commented that the corporation had responded
to all complaints filed; had relocated the parking to try to alleviate
those problems, had fenced in the area as a traffic control mechanism
and reque I sted that this matter not be considered at this time pending
the litigation now in the District Courts.
Mr. Shafer, owner of the property made a lengthy presentation regarding
_various exhibits and graphics in support of his position to deny this
request to prohibit this activity; that he questioned the validity of
the Council rezoning this matter when the request is not made by the
property owner himself, to which City Attorney Ross responded that the
Council can zone or rezone any property it so wishes and from his presentation
by requesting that this matter not receive further consideration. Mr.
Kuhne Attorney on behalf of Graham and Associates strongly stated
that this is the wrong forum for this matter and that the matter should
be resolved in the Courts where the litigation is currently pending.
Proponent Langston made a presentation on behalf of his clients who actually were
the proponents of the case although not the present land owner; that
they had previously sold this property years ago not realizing that it
would be used for this purpose and would cause the continuing problem;
that they presently own adjacent lots as referenced above and therefore
are seeking to have this matter rezoned prohibiting these uses as stated.
He also gave a historical overview of the circumstances involved in this
particular case. Various citizens of the area appeared - each stating
his opinion and objection to the location now occupied by the New West
Club said objections being the loud noise, the damage to adjacent
properties, fear for safety - particularly to women who live alone in
the area, the continual clutter and trash left by the party -goers at the
Club and on -and -on.
In rebuttal, Mr. Shafer ' asked the Council to consider only limiting the
Lot 13 on which the New West building is located to this zone change
request; Mr. Kuhne reiterated that this is the wrong forum to consider
this matter and Mr. Bertram, Director of Planning again reiterated the
major points to be considered giving onee again the historical overview
of how the present situation came into being.
All discussion and rebuttal comments having been completed, the hearing was
closed at 12:25 p.m.

82-41-1002-1572 Hold a public hearing on the application of Texland Petroleum Inc. for
(26) an Oil and Gas Drilling Permit, referred to as A.L. Horne #1 well site,
*Publishers Affidavit bearing municipal street address of approximately 1/4 mile south of Kent
Page 1002 (above) and approximately 3/4 mile east of University.
In accordance with the Notice published April 7, 1982 in the Lubbock
Avalanche Journal a puulic hearing was held on the above watter.
Proponent: Dub Bratcher, Attorney on behalf of Texland.
Mr. Bratcher indicated that this location is isolated and the only deviation
from the application as filed would be to request that earthen pits be
permitted for they are less expensive and by using the plastic lining,
there would be no danger to the surface area; that the staff had met with
him regarding certain terms and conditions to the permit and they had no
problem with this per se.
Mr. Bertram apprised the Council that Texland was the sole lease holder
and therefore this was not a unitized agreement operation. That the tract
of land is zoned R-1 and the land use plan indicates this area would be
developed for industrial park uses and the well site is located on
agricultural land and could have access from Kent Street to the north.
The recommendations to the Council for conditions to be stated in the
permit are:
1. That the applicant file a written notice to the Fire Department
at the start of the drilling and the completion of the well
in order for fire inspection and necessary fire fighting equipment
to be established by the Fire Department.
2. That steele sludge pits be required during the drilling operation,
to be removed upon completion of the drilling operation.
3. That upon completion of the drilling operation, the applicant
dispose of all waste and sludge material at a location designated
as Section 34 Blk. D-11, the Morgan Stern property located
outside of Lubbock County, and as approved by the Railroad
Commission; that documentation as to this location be placed
on file with the City Secretary.
APR 2 Z 1982 1003
4. All flow lines from the well head to the storage tank be buried
at a minimum of 36"
5. That the applicant shall install a 3000 lb. rated blowout
preventer, said preventer to be tested a minimum of 3000
lbs. after the surface casing is set and again, at approximately
100, prior to entering any high pressure strata recorded by the
Texas Railroad Commission.
6. A chain link fence of appropriate height for safety should
be placed around the storage facility.
7. That the applicant shall meet all other standards certified to
the application which are not in conflict with the stated
conditions.
There being no opposition and no discussion, the hearing was closed.
82-41-1003-1573 Consider authorizing the above referenced Oil and Gas Drilling Permit to
(27) Texland Petroleum Inc. (A.L. Horne 1) -
The motion was made by Councilwoman Baker, seconded by Mayor Pro Tem Henry
to approve the above referenced permit as requested by Texland (A.L. Horne
#1 well site) and to approve all stated conditions as recommended by the staff
with the exception that earthen sludge pits be approved using the plastic
lining. Motion carried: 5 Yeas; 0 Nays.
This hearing concluded at 1:32 p.m.

r7,
This is the third request for this particular permit although in each
instance, there has been some variation in the location of the well
site. The application was originally filed and the first public hearing
was held in March, 1982, said hearing being continued. At the time of
the continuance of the hearing, the well site had been relocated to a
different lot resulting from a complaint from a lease holder and this
incorporated different adjacent property owners to which notice had not
been given and that permit was denied at that time. This application
involves many of the same lease holders but the composition of the 40
acre production unit has varied and the location of the well site is
different completely.
This has become a very controversial application/location and the particular
issue of this public hearing was that the location of the well site is
on agricultural property owned by Joe Dale Bryan and Lewis Murfee
and under lease to Texland; that the proposed property was forced pooled
by Sentry and there has not been any contact with the property owners as
to granting permission for this location and it is the Bryan-Murfee
position that this is a definite violation to the ordinance prohibiting
trespassing and they feel the Council does not have the authority to
approve this permit when it is in violation to the existing ordinance
relative to trespassing on anothers property.
Mr. Bertram indicated that the well site had been moved from the northwest
corner of Yucca Lane and Mesa Road, which was a point of controversy at
the first public hearing, to a large vacant lot at the northwest corner
of Vega and Manioca which is within 260' of a single family residence facing
Manioca; that there are eight other houses within the 600' well site, a
proposed new standard and landscape screening should be considered therefore;
that the proposed tank battery is within 280' of the closest residential
structure and a matter of fencing and/or landscaping should be considered;
and the ingress -egress routes to this site would be from Cypress Road on the
south, Mesa Road and Vega Lane or Yucca Lane and Manioca. There are fewer
houses exposed to truck traffic if Yucca Lane and Manioca Road were required.
Mr. Bertram indicated that the following permit conditions should be stipulated
if the permit is in fact granted:
1. That the required bonds should be submitted to the City Secretary
before drilling.
2. That evidence of notice to non -unitized owners has been filed with
the City Secretary as of this date and therefore it would not be a
stipulated condition to the permit.
3. That the Fire Department should be notified in writing when drilling
operations commence and upon completion for inspection and fire
equipment standards to be determined by the Fire Marshall.
4. A chain link security fence should be installed around the
pump jack and a landscaping screen should be installed and permanently
maintained by the applicant using 8' pyramidal evergreen trees
installed at 6' centers outside the chain link fence excluding
a 15' service entrance to the fenced area on the west side.
5. That the applicant should install a 3000 lb. blowout preventer
and the preventer should be tested a minimum 3000 lbs. after
the surfac casing is set and aee gain at approximately 100' prior
to entering any high pressure strata recorded by the Texas
Railroad Commission; that the applicant has filed with the City
Secretary the designation of the sludge and waste materials in
Gail - 12 miles east of Gail - and that more specific information
should be supplied for appropriate documentation.
6. That the applicant shall meet all other conditions of the ordinance
and those standards specified in the application unless in conflict
with the above stated conditions.
The rebuttal from the opponents particularly from Mr. Murfee as a
property owner, intensified and Mr. Bertram responded to his comments
that trespassing is a problem not in question at this point but -should be
determined between the parties in the District Court; that a valid production
unit has been assembled by Sentry and that the condition of the Performance
Bond being on file before drilling operations commence as stated as a
condition in the permit.
Following all discussions, rebuttal and comments by Staff and Council, the
hearing was closed at 2:45 p.m.

82-41-1007-1579 Consider an ordinance amending Chapter 21 of the Code of Ordinances
(42) establishing fees and licensing ,requirements for peddlers, hawkers,
itinerant merchants and transient vendors.
Ordinance No.8319
On April 8, the Council discussed the proposed ordinance in work session
to revise and up -date the requirements for a peddlers permit which is
currently being issued by the City Secretary's office.
During the work session of this date, the Staff reported to them the ID
provision which could be available through the Transit Department,
but would require an increase in the proposed fee from $11.00 to $20.00
to off -set the cost for the identification card. The proposed ordinance would
exempt a commercial traveler who exhibit or sale wholesale goods or
merchandise to parties in retail businesses; to sales, exhibits at
fairs, rodeos, conventions, or Civic organizations, charitable organizations
or the Chamber of Commerce sponsored events; and to all charitable
solicitations. The proposed ordinance also stipulates the terms and
conditions with which a permit may be denied or revoked by the City
Secretary or Chief of Police, respectively.
The Council was apprised that this is a "no win" situation and difficult

to enforce but it would serve as a deterrent to the itinerate vendors
that come in droves to the City and that under the proposed ordinance
the permit would be in effect for only 30 days. The purpose being
that it would keep current for our information, as well as the Better
Business Bureau , those who are on the street marketing various

would be required which is keyed with a document description and the roll
and the frame to locate the desired document. If approved, this system
would be coordinated with the City's Microfilming Department and the
proposal would provide for a keypunch operator as well. The total proposal
is approximately $52,000 and capital equipment would include a micro-
