Motion carried: 4 Yeas; 0 Nays; Mayor McAlister absent. 82-41-873-1312 James G. Marshall will appear to present drainage problems from 19th St. and University (15) Avenue to Stumpy Hamilton Park. Mr. Marshall requested to appear before the Council to discuss drainage problems from the area of 19th and University near his home located at 2217 24th Street in the vicinity of Stumpy Hamilton Park. Mr. Marshall's presentation reflected that there are high water problems resulting from heavy rains which are diverted by Texas Tech and inundates the area at 22nd and Ave. W. This area was developed prior to the playa lake ordinance. Mr. Marshall has made reference to this matter on enumerable times in the past, and the City engineers have reviewed the situation and feel that a lot of the drainage problems have been resolved by the present paving and storm sewer installations, and possibly there is not a justifiable cause. 82-41-873-1313 Sam Lupton of Lupton Painting Company, will appear to request waiver of liquidated (16) 'damages, and ill request Council to consider actiontakenon January 14, 1982. Mr. Sam Lupton, of Lupton Painting Company appeared to request waiver of liquidated damages. On March 12, 1981 (Resolution 749) he was granted the contract to repaint the water tower at 35th and Avenue W; he ran into some problems getting the proper insurance coverage and as a result incurred some penalties for 48 days at $200 per day ($9,600) for failure to complete the project as under the contractual terms. The total contract was for $68,900. In his comments, Mr. Lupton did not hold the City liable in any way, but it was in his opinion a situation out of his control resulting in the delay in the issuance of the proper insurance. In response to Council query as to the damage done to the residents' vehicles that were sprayed from the painting project, he replied that he thought all claims had been settled. The Council also reminded Mr. Lupton that it was his obligation as a businessman to secure the appropriate insurance coverage, and he was requesting the City to obsolve him of this responsibility and to share his burden with him. Following discussion, the motion was made by Councilman Aderton, seconded by Councilman Brown to deny.his request to waive liquidated damages, and to let the matter stand as it was presented originally. Motion carried: 4 Yeas; 0 Nays. Mayor McAlister absent. 82-41-873-1314 Helen Otken, President of the Friends of the Library, will appear to present Branch (17) Library study. Resolution No. 1024 The Urban Design Commission is interested in preserving the character of Broadway and other streets in the Original Town area in the central business by preserving the red brick pavers which are characteristic of the early 1920s. The Commission has discussed the restoration of Broadway in particular as a project for the Texas Sesquicentennial Celebration. This resolution is a policy statement, whereby patch -work of brick with asphalt or concrete in the street after utilities repairs is discouraged, thereby requiring the reinstallation of the appropriate bricks. The resolution was adopted by the Commission on November 19, 1981 and by P & Z at the January 7, 1982 meeting. The Council expressed their desire for all brick paver streets to be preserved, and suggested that the policy be expanded to include all of the area; that it is definitely characteristic of the West Texas early development and the patch -work concrete is unsightly. The motion was made by Councilman Brown, seconded by Councilwoman Baker to pass Resolution No. 1024 as written extending the policy to include all brick paver streets. Motion carried: 4 Yeas; 0 Nays; Mayor McAlister absent. SMH:mck RESOLUTION NO. 1024 A RESOLUTION ADOPTING THE CONTINUED PROTECTION OF BRICK PAVERS ON LUBBOCK STREETS. WHEREAS., the City Commission authorized Lubbock's first brick street paving in 1920; and WHEREAS, the first portions of streets to be paved included the area around the Lubbock County Courthouse; and WHEREAS, these brick paving projects were continued throughout the 1920's and 1930's, and include many miles of brick streets; and WHEREAS, many of Lubbock's brick streets are paved with red brick manufactured by the Thurber Brick Company, Thurber, Texas, which is no longer available; and WHEREAS, brick streets are a part of the heritage of Lubbock; and WHEREAS, preservation of this heritage will benefit existing and future generations of Lubbock citizens; and WHEREAS, brick streets provide a continuing useful and low maintenance paving material; and WHEREAS, numerous utility repairs and installations, street repair, and re -surfacing of intersecting streets have left Lubbock's brick streets a patchwork of brick, asphalt, and concrete; and WHEREAS, the Urban Design and Historic Preservation Commission and the Planning and Zoning Commission for the City of Lubbock have resolved that the preservation and restora of brick streets is a continuing source of community pride; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT any portion of any brick street surface disturbed by any public or private agency for whatever reason be replaced in a manner consistent with original construction. City Attorney A brief recess at 10:26 a.m was called in preparation for following Zone Case hearing. 82-41-878-1329 Zone Case No. 2353 - Ordinance No. 8292 (31) Continue public hearing to change Lot 7, Block 1, A. Boyd Addition from R-3 to C-4 Zoning 11 District, located at 1909 Avenue K. (Proponent: John J. Mulford, Vowell and Craig Properties). Planning and Zoning Commission recommends this request be approved. In accordance with Notice published in the Lubbock Avalanche -Journal on January 12, 1982, a public hearing was held on the above referenced matter. At the appointed time of 10:30 a.m. a public hearing was continued on the above matter. Proponent: John J. Mulford Opponent: Mrs. Evelyn Campbell Mr. Mulford requested the zone change from R-3 to C-4 to allow the used car business to extend their business southward one lot. As indicated at the P&Z hearing, the building will be masonry structure with a stucco exterior finish. Mrs. Campbell once again appeared on behalf of herself and members of the Odd Fellows and had no objection to the zoning change, nor to the masonry construction of the building, but they were wondering about the set back requirements and the type of materials to be usedon the roof; that they had the corrigated sheet metal roofing, across the alley which did not blend in with the residential area, and she wanted the proponent to specifically state the type of material he intended to use; additionally, she requested at least a 20' set back from the side walk. The plat filed and submitted by proponent would indicate at least a 70' set back from Avenue K sidewalk as well as a 101 set back from the alley; that the proposed building would be approximately 50' X 50' and that he would be more than willing to stipulate that the roofing would be of non-corrigated sheet metal material but in compliance to the standard roofing construction used by engineers or builders, to which Ms. Campbell stated that she would be "watching" during construction, and would file a protest should they deviate from the stipulation. There being no further discussion, the hearing was closed at 10:40 a.m. and the motion was made by Councilman Aderton, seconded by Councilman Brown to pass Ordinance No. 8292 on first reading subject to the stipulation by proponent that the building would be a masonry construction with a stucco exterior and prohibiting the sheet metal corrigated iron for the roof. The area does qualify for CD assistance. There is a segment within the area that has standard platting.' requirements and then there is a segment that has no standardization in platting requirements at all and, therefore, the area has become difficult to maintain. Apparently, according to Mr. Gonzales, this request was not considered by the CDAC hecause there was some doubt as to whether or not the residents would relocate in the area after being rehabilitated by the Urban Renewal Agency; but he assured the Council that this was erroneous and it was the desire of these residents to maintain theik.neighborhood associate Mrs. Scott and Mrs. Shed supported Mr. Gonzales' statements, Mrs. Shed indicated that there was inadquate street lighting, and a need for street paving, and with the high water/easy flooding conditions, many of the streetswere impassible in wet weather. Mr. Gibson's comments were in support of the sewer system for the Yellowhouse Canyon Addition which is recommended by CDAC. Mr._ Hastings again apprised the Council that the previous year, the renovation of the shelter workshops for MBMR located at 38th and Avenue H was given high priority, and yet it was not recommended by CDAC this year at all. He asked the Council to reconsider this request as being very worthy. I I I I I . Upon hearing all presentations and testimony from citizens, the hearing was closed at 11:35 a.m. Following lunch, in Work Session the items were discussed at greater length. The staff recommended to the Council for consideration the following items, which were not considered by CDAC: South Overton Park Land Acquisition - $75,000 If this project, which was commenced in CD years 5,6,and 7, is not completed, the City will have possession of several vacant lots without the necessary park facilities for this area, as proposed in previous years. The purpose of this project was to assist the neighborhood in having park facilities and it bears completion. MacKenzie Softball Renovation - $78,000 This item was not recommended by CDAC, but it is necessary to renovate softball fields that are used extensively by inumerable softball teams in the City and to accommodate tournaments. Intensified Code Enforcement - $82,000 This program was not recommended by CDAC, but staff feels that it is very necessary in maintaining existing neighborhoods and preventing the decline by deterioration of other neighborhoods. Intensified Code Enforcement program minimizes the deterioration of housing standards and the visibility of junk vehicles and related unsightly matters that accompanies a declining neighborhood. The discussion of the Council reflected that Meals -On -Wheels program, as recommended by CDAC, should be handled through private funding; that the request at the previous Council Meeting was declined because it is operational in nature, and does not reflect any capital improvements. Additionally, in response to the citizen input at the public hearing, there needs to be assistance to the PLEA group for Intensified Code Enforcement, as well as improving that area by the extending and improvement of East 19th Street paving and the intersection--Idalou Road and 19th (estimated at $145,000 for purchase of right-of- way). The Council also agreed with the staff's recommendation that the South Overton Park project needs to be completed, and that needed to be given strong consideration. Additionally, there are 12 houses on the waiting list for weatherization, and the funds are depleted for that, and those homes that are on the waiting list should be given consideration. This indicates that no new housing should be placed on the list; only those presently qualified. Following all discussion, by CONSENSUS the Council approved the following items to be considered at the second public hearing. Urban Renewal Agency $1,597,000 Cherry Point Addition Rehabilitation 75,000 Paint Up Program 10,000 Emergency Repair Program 15,000 Mae Simmons Senior Citizens Center 192,000 Copper Rawlings Community Center 39,500 MacKenzie Softball Fields Renovation 78,000 MacKenzie Park Buildings - New Water Lines 18,000 Hollins Park -upgrading 15,000 South Overton Park - Land Acquisition 105,000 Porta-Printers-Fire & Police Departments 1,400 Street Paving- East 19th Street 145,000 Residential Street Lighting-Yellowhouse Canyon 2,000 Sewer System-Yellowhouse Canyon 93,000 Code Enforcement 145,000 Intensified Code Enforcement 82,000 PLEA (Posey Lakeside Addition) 10,000 CD Administration 97,000 Indirect Cost 50,000 Weatherization 35,000 Administration 100,000 TOTAL $2.,905,000 Councilman Aderton requested to be excused from the Council Chambers long enough to attend a funeral. (45) Councilman Aderton has rejoined the group. Assistant City Manager Jim Blagg presented the Staff's report on the water system situation in Yellowhouse Canyon, pursuant to Council's instructions of January 28. At that meeting, Ms. Wenzler requested the Council take action on the following matters: 1. That the City water services be extended to Yellowhouse Canyon pursuant to Chapter 34 of the Code of Ordinances. 2. That the Council apply for a Certificate of Convenience and Necessity from the PUC pursuant to Subsection 54 of the Public Utility Regulatory Act. 3. Waive the deposit required for water service pursuant to Section 3425 of the Code of Ordinances. 4. Use CD Contingency Funds for extending the water service, either for the pro rata share, for the purchase of meters, or to purchase the existing distribution system. Mr. Blagg indicated that Mr. Alan King, General Counsel for the PUC, has apprised the Council that in the event the City would apply for a Certificate of Convenience and Necessity from the PUC, it is a prolonged process and subject to challenge inasmuch as the present owner, Mr. Travis Martin under the "grandfather clause" has a Certificate of Convenience and Necessity. Additionally, in the event that Mr. Martin defaults in his requirements stipulated by the district court to bring the system into compliance, and in the event the system will be placed into receivership, the challenge procedures mandated under the PUC and the termination of the matter could be prolonged. With regard to request No. 1, above, Chapter 34 of the Code makes provisions for two methods of water service availability into platted and developed areas that are annexed into the City: First, there is required a payment of pro rata charge by the property owner to an extension of 150' and the frontage of the lot upon which he pays the pro rata charge. The Staff calculates that 50 property owners would need to enter into contracts to pay their pro rata amounts to qualify under this provision. The Staff also calculates an estimated cost for the approach line to be $97,000. Most of the lots in the area are 60' lots and the cost for a 60' lot would be $405, plus a $120 charge for the tap and meter, plus $15 for the water deposit. There is a time -payment plan provided by the Code requiring a 15% minimum payment or $60.75, with 36 months to pay the remaining balance at 6% interest. The second method under Chapter 34 provides for the extension of water service into an area at t the City's cost, without a deposit from the property owners, if it can be determined that i is necessary to "avoid and eliminate extremely unhealthful conditions which are contributing factors to epidemics." The State Health Department has inspected the area and there are unhealthful conditions existing, but not to the extent of epidemic factors. Therefore, the Staff does not feel that the Yellowhouse Canyon Addition qualifies under this provision. With respect to No. 2 above, the Certificate of Convenience and Necessity cannot be applied for until the required number of property owners have filed their contracts for pro rata, and it is City Attorney Ross' opinion that the ruling of the General Council for the PUC would indicate a prolonged hassle because of the existing Certificate of Convenience and Necessity now awarded to Mr. Martin. Therefore, this request, or alternative, is not practical at this time. With respect to request No. 3 above, a state of emergency does not exist at the present time, according to the Staff's evaluation, and fire service has been provided by using pumper trucks which carry 1,350 gallons on the first alarm and an additional 800 gallons on the second alarm. Since the area was annexed into the City in 1978, there have been twelve alarms with only one major house fire resulting in extensive damage. With respect to request No. 4 stated above, the area does qualify for CD Contingency Funds, but an assessment program is not allowable in the event these monies would be used to provide the system. Ms. Wenzler was present in the Council Chambers and reported that the District Court has given Mr. Martin 30 days to comply with the injunction, and the 30 days has run with no evidence of his compliance. It is her understanding that the PUC will now file contempt charges against him for noncompliance, the outcome of which could result in imprisonment, a heavy fine, or II _2 other disciplinary action pursuant to discretionary judgment of the PUC. What to do: City Attorney John Ross recommended that the Association attempt to secure 50 property owners who would be willing to enter into a contract for a pro rata assessment program to provide for the water system, it being made perfectly clear that the water is provided as an approach main, it being the property owner's responsibility to "tie on" from the residence to the approach main. Upon receipt of sufficient number of contracts, then the Certificate of Convenience and Necessity will be applied for, it being his thinking that it will be difficult to decline this request in light of the circumstances. He also mentioned that once the Certificat of Convenience and Necessity is approved, the City is mandated to provide service into the area. The members of the Addition are requested to have these matters in order for consideration by the Council at the February 25 Regular Meeting. As one final comment, Ms. Wenzler asked the City to consider purchasing the existing distribution system.
