The second contract is for the Nutrition Program and will expire December 31 of this year. This Program provides 305 hot meals per day at six locations throughout the City. Contributions by the participants have increased 33% ($22,761). There is a limited home delivery service provided to those senior citizens unable to attend at the community center. The total contract involved is $106,622 with in -kind and cash participat on the part of the City. The contract is for nine months, which leaves a deficit of $25,750 for the remainder of the year, which would allow both contracts to be valid simultaneously. There are five satellite locations that operate under this Program using part- time personnel. The Parks and Recreation Board has reviewed the Title III Nutrition Program and recommends its continuance beginning January 1, 1982. Additionally, they recommend the deficit of $25,750 to be funded from CD Contingency Funds. The motion was made by Mayor Pro Tem Henry, seconded by Councilman Aderton to pass Resolution No. 969 authorizing the contract for the Title III Nutrition Program and authorizing the allocation of $25,750 from CD Contingency Funds, Grant Year VI . Before balloting, Council Brown apprised the Council and members present in the Chambers that while he had nothing personal against any of them regarding this particular Program, that he had not seen any variations from his original feeling a year ago at which time he opposed the Title III Program, and he felt very strongly that there were participants who should be paying their own way and there were other abuses related to the Program, and he felt that the Parks and Recreation Department should get out of the "food handling, construction and money -hustling business and get back to flowers, weeds and the park program;" and because of his strong feelings, he would have to vote against this matter. Motion carried: 5 Yeas; 0 Nays. 81-40A-758-1074 Consider a resolution amending the street use license, street and (18) alley closing and easement closing policies. Resolution No. 972 The original policy establishing street use and alley use licenses is dated in 1967. No update has occurred since then. The primary interest is to establish reasonable policies and charges for private individuals using public property. The proposed resolution would establish a $150 non-refundable application fee for processing street use licenses and street/alley closures. The street use license would cover private users of encroachments on public property and public easements, and the cost of the license would depend on the type of encroachment, of which there are three: l.. Surface The surface leases include parking of motor vehic or storage of equipment or materials with no construction of building or structure permitted, temporary structures, utilities, planter boxes, etc. The proposed fee is 10% of the fair market value. 2.. Subsurface -- Subsurface licenses include underground passa utilities, tunnels and basements. The proposed fee would be 10% of 60% of fair market value. This fee is less because the public is not visually or physically obstructed by the encroachment. 3. Aerial -- Aerial licenses include building overhangs. The fee is based on 10% of 75% of fair market value, the differentiation resulting from the public being visually in contact with the encroachment. The street use license fee is computed annually with a minimum annual fee of $50.00 for a period of five years, and the license is subject to review and increase at the end of each five-year period. The license provides for a lien being placed upon the property in the event of default of payment of the necessary fees. The street use policy would require that fair market value be established with appraisal being handled by the Right -of -Way Department. Original dedicators would be exempt from any charge by the City in the event of street/alley closures. The Planning and Zoning Commission would still be required to approve a new plat when an alley or street is abandoned, and the Right -of -Way Department will conduct the appraisal process in establishing the fair market value. Director of Public Services Denzel Percifull apprised the Council that research had been done with twelve other cities of comparable size and a medium average was then determined thus setting the proposed fees as recommended. The motion was made by Councilman Brown, seconded by Councilwoman Baker to pass Resolution No. 972 establishing the new street use license, street and alley closing and easement closing policies. Motion carried: 5 Yeas; 0 Nays. This fee shall be non-refundable, regardless of the ultimate action taken upon the matter by the City Council, and shall be in addition to any other charges hereinafter described. Such fair market value shall be established by appraisal by the City of Lubbock Right of Way Department.
