Trial Attorney Jim Brewster appeared before the Council to officially state that Notice of this matter had been advertised in accordance with the law; that Ordinance #8232, as this is numbered, amends Ordinance 8195 passed by this Council on these same bonds in May, 1981, and paraphrased only those paragraphs that differed or had been inserted. Mr. Brewster also stated that the validation proceedings had been held in the District Courts of Lubbock County, and all procedures and documentation had been complied with under the law. Following his presentation, the Motion was made by Mayor Pro Tem Henry that the reading of the ordinance in its entirety be omitted with the exception of those sections revised or newly inserted, as read by Mr. Brewster. Motion was seconded by Councilwoman Baker. Motion carried: Mayor McAlister, Mayor Pro Tem Henry, Councilman Brown and Councilwoman Baker voting Yea; None voting Nay; Councilman Aderton absent. Prior to action on the ordinance itself, the preliminary comments reflected that all members of the Council would have preferred a leer interest rate, but under the circumstances it was the best that could be attained; Mayor McAlister again reiterated that the delay in the Council's action was costly. Councilman Brown stated that he would not be voting against the ordinance at this time; that the voice of the Council in its majority support of this issue had prevailed, and he would go along with that; that admittedly he and Councilman Aderton did attempt to prevent this matter from passing, and that although his convictions had not changed, in the interest of unanimity of the Council, he would not oppose this matter on this date; that there are definitely some problems facing LP&L which would need all of the effort and support of all Council members. Councilmwoman Baker responded that she was glad to hear his statements, because the Council, as Board of Directors of the utility company needed his (Councilman Brown's) expertise in business management, and it was imperative that the Council concentrate on making LP&L a_profitable business.
