Councilman Aderton asked to abstain from this matter. At the 8:30 Work Session, Director of Planning Jim Bertram apprised the Council of the concerns that the Traffic Engineering had, which are the same concerns they had when the proponent made the request in November, 1979. Subsequent to his comments, City Attorney John Ross indicated there were three areas of concern from a legal point of view, which s are: (.1) the median removal policy passed by the Council by resolution on October 26, 1978; (2) the liability of the City proving such a hazardous left -turn lane at a busy intersection; and, (3) whether or not the responsibility of such a hazardous location could be transferred to a third party through a hold harmless agreement. At the Regular Session, Burl Masters, on behalf of Texas Bank, appeared to again make the Bank's request for a left -turn lane on University at 20th Street. He apprised Councilwoman Baker and Councilman Brown of the pertinent matters discussed at the November, 1979 Council 475 JUL -9 1981 Meeting; that the request was initiated due to restrictive ingress and egress to the drive-in window at Texas Bank located on the southeast corner of University and 19th Street intersection; that presently the only access to the drive-in window is from a right turn from northbound University onto eastbound 19th Street and concurred that there had been several accidents at this congested intersection. In regard to Mr. Bertram's concern about the stack lane and the overflow traffic blocking other traffic lanes as well as the effect on the traffic flow, Mr. Masters indicated they took a vehicle count on July 6 (all day) counting 600 vehicles of which 411 were gaining access to the drive-in window at the Bank. He reiterated that the stack lane would accommodate nine vehicles without an overflow; that the concern would be at the evening peak hours ( ' 4:30 to 6:30 p.m.) and cited other requests that had been allowed where there were similar situations, although not at a busy intersection location. Mr. Masters further stated that the Bank was willing to assume all of the costs for the median cut; that the existing landscaping items could be transplanted and salvaged, to include the sprinkler system, and they were most willing to work with the City Engineering staff regarding the construction and specifications required. Mr. Bertram, at the Regular Session, briefly reiterated his concerns stated in Work Session, and the traffic count that the Traffic Engineering made in November, 1979 reflected considerably more vehicles, primarily because Texas Tech was in session at that time. City Attorney John Ross, again, stated his three concerns for the benefit of the proponents in the Council Chambers, and stated to the Council that the existing resolution establishing the median policy could not be waived, but would need to either be amended or rescinded; that it was imperative that these steps be taken in order that all citizens are treated equally. He cited various court cases in support of his second concern about the liability to the City as well as to whether or not the responsiblity of this matter could be transferred to a third party using a hold harmless clause as the vehicle for doing so. In the discussion that followed, the Mayor expressed some concern that the Traffic Engineer's opinion would be of such a libelous nature placing the Council in a difficult position, and queried whether or not the liability was based on one accident, a series of accidents, or what would be the criteria for such liability. Mr. Masters indicated that he thought it was a matter of semantics; that is, removing the median vs. modifying a median. Kennett Hobbs, Attorney and Director of Texas Bank, appeared before the Council and indicated that he, too, had read all the cases stated by Mr. Ross, and it was his interpretation that two conditions need to exist before a municipality could be held liable for negligence in the maintenance or construction of streets involving traffic flow, that being whether or not an unsafe condition does exist with a history of accidents occuring under the existing conditions, and whether or not the municipality has attempted to remedy the matter after they have been put on notice that a hazardous conditioi does exist. It is his thinking that an unsafe condition does not exist at the present time the request is made, nor is there any history of a situation or condition in support of a hazardous existing condition. In summary, he commented that the request was made by local folks who are taxpayers just as the members of the Council are, and although the request would definitely be beneficial, they were not wanting to create any traffic hazards intentionally; that they would pay for the total cost for the project if the City grants permission to do so, and in the event the situation becomes hazardous with innumerable accidents occurring, that the Bank would not be opposed to closing the median and would pay for the costs in doing so. Following all discussion, Councilman Brown indicated that he felt the Bank was entitled to a decision today, and he therefore moved that the request be approved, and that the existing median policy be modified to accommodate the situation as it now exists; that the Bank pay for all costs; that the situation be monitored for two years and if it is determined to be a hazardous situation, that the matter be reconsidered, and in the event that the median be reclosed, the Bank is to pay the entire cost of returning the condition as it was originally. Mayor Pro Tem Henry queried as to how the resolution was to be amended, that is, what is the exact wording to be. Councilman Brown responded that there was considerable discussion when the widening of University from 4th Street to 19th Street was considered at which time a great deal of consideration and flexibility was allowed the merchants at that time to accommodate their respective problems, and he felt that equitable consideration of flexibility should be allowed to the proponent. In response to the Mayor's question as to whether or not he would amend his motion to reflect that the recommendation be from the staff as to the appropriate modification of the existing median policy, Councilman Brown concurred that he would amend his motion to reflect that. Additionally, he stated that if the existing resolution establishing the policy is so inflexible as to not allow any variance whatsover, then the resolution needs to be modified and revised anyway. 476 JUL -9 IggI Councilwoman Baker indicated she had great compassion and understanding for the Bank's problem and she was definitely pro -business philosophically, but she was unable to support this request in that, in her opinion, the traffic is one of Lubbock's greatest problems, and the City is in the process of spending $2,000,000 to study and attempt to correct the situat and she felt this particular request was not helpful to the overall program in any way. Councilman Brown replied that the situation was not a black -and -white decision, but it was an area that the City Council needed to give a trial and if unsatisfactory, to reconsider the matter at an appropriate later date. Mayor Pro Tem Henry indicated he would second the motion with the understanding that prior to second reading, the exact wording of the changes proposed in modifying the median policy be submitted, for he must know exactly what the position will be in the future as stated in modifying the existing policy; that if it is impossible to word the resolution without opening "Pandora's Box," he would not be available to vote for at that time; furthermore, that should the circumstances evolve requiring closing the median again, that this be based on the professional judgment as recommended by the Traffic Engineering Department, and the Council's position to do so would be based on this recommendation. Councilwoman Baker indicated this was a resolution that required only one reading. City Attorney Ross suggested that the entire matter be held and referred back to the staff for recommendations in modifying the existing resolution regarding the median policy, and resubmitted to the City Council at the July 23, 1981 Meeting, as modified. This is to say that two items would be considered: (1) modification of the median policy, and (2) the request of Texas Bank for a left -turn lane at 20th and University. Mayor McAlister asked Councilman Brown if he would concur with this suggestion, and if so, to restate his motion. Councilman Brown, therefore, moved that the entire matter be held until the July 23, 1981 Meeting, at which time the staff will (a) recommend a resolution modifying the existing median policy, and (b) a decision be made in response to the request of Texas Bank for a left -turn median cut at University and 20th Street. Motion carried: Mayor McAlister, Mayor Pro Tem Henry and Councilman Brown voting Yea; Councilwoman Baker voting Nay; Councilman Aderton abstaining. 81-40A-476-652 A_representative .2.f the Lubbock Cultural Affairs Council to appear o present recommendations 7) for awarding of art grants for the first half of 1981. When announced by the Mayor that this item was next to be considered as an emergency item, City Attorney John Ross indicated that pursuant to Article 6252-17, 3A, (h), "In case of emergency of urgent public necessity *** it shall be sufficient if the notice is posted two hours before the meeting,j_s onvened," the Notice was posted at 8:30 a.m., which is one hour deficient of meeting the requirements and it cannot be considered at all. Additionally, as reflected in the December 1980 Minutes and pursuant to Article 974A, the Platting Committee within the Planning and Zoning Commission has full jurisdic of private streets under the subdivision regulations as stated in the Code, and Mr. Bradshaw's request affects a private street within the Whisperwood Addition, and his request can only be considered by the Platting Committee and the Planning and Zoning Commission. Mr. Bradshaw indicated that he had been before so many committees that he was totally confused as to who had jurisdiction, and Mr. Bertram responded that he would explain it to him and if necessary, see if the Chairman of the Planning and Zoning Commission woul callairman of the Planning and Zonine Commission would call an emergency meeting to consider this request. City Manager Cunningham apologized to Mr. Bradshaw for misleading them as to the two-hour requirement for emegency items, it being his impression that the item could be considered after two hours notice, but evidently as stated by City Attorney Ross, he was in error. 81-40A-481-658 Consider a resolution authorizing the sale of remnant City for the (,13) ta in West Lawn Addition to the City of Lubbock, LubbockCounty, Texas. *See Reso 830 Resolution No. 861 (.6/18/81) for the authorization of At the June 18, 1981, Regular City Council Meeting, the Council authorized sale. the sale of this property which is City -owned or classified as "remnant" property, and authorized proceeding in accordance with law. ("The Rick Childers Show") Ordinance No. 8203 Mr. Rick Childers, Administrative Assistant, apprised the Council that on July 2, 1981, staff members met with representatives from the industry (20 people representing 12 businesse and apprised them of the proposed changes following the discussion at the June 25, 1981 Work Session. All of those present voted, voluntarily, to accept the changes in general and in principle, and they were assured that a smooth implementation of the procedures would be accomplished, specifically: Section 31-63, Wrecker Business. The definition of this term was modified regulating all wreckers operating on the streets of the City of Lubbock, exemptions being granted only to governmental entities or to out-of-town wreckers who enter the City to pick up a tow and leave immediately thereafter. Section 31-65 (a) (5). A certificate from the City Tax Assessor -Collector would be required on all applicant's property, both real and personal, used in the business, the applicant being responsible only for the taxes on his business property in the event his premises are leased from someone else. Section 31-66 (c). The permit holder shall pay a non-refundable fee of fifteen dollars ($15.00) for each wrecker's certification. Section 31-67 (4). The standard equipment shall be a tow bar, safety chain and fire extinguisher. For those wreckers used in collision hauls, they shall additionally be required to carry a wrecker bar, broom, ax, shovel and dolly. Section 31-67 (5). The permit number of the permit holder shall be reflected in letters at least 3" high on the side of wrecker attached on a contrasting background. It shall be the discretion of the individual wrecker business whether or not his name is placed upon the doors of his cab. Section 31-76 (e). A permit holder removing a vehicle from a private property shall immediately upon completion of the tow notify the City Police Department of such removal. To comply with the federal regulations, Sec. 31-77 (g)(h) was created whereby a tow initiated by a police officer without the knowledge of the vehicle owner, the Police Department shall as soon as possible notify the person of the impoundment of the vehicle. The purpose of this provision is to allow the vehicle owner the opportunity to challenge the decision of the police officer regarding the impoundment and resulting storage charges. In the event of such a challenge, the Police Department will collect a cash bond from the vehicle owner, and upon receipt of the bond the wrecker business towing the vehicle will be notified to release it to the owner and schedule an administrative hearing on the matter by the Police Chief or his designee within ten days. If the decision of the impoundment is favorable, the cash bond will be forwarded to the wrecker business that impounded the vehicle; in the event the decision of the impoundment is found to be improper, the cash bond will be returned to the owner and the City will be responsible for the tow and storage charges. The City shall not be responsible for damages to the towed vehicle or loss of any property from the vehicle, such claims being the responsibility of the wrecker business conducting the tow and storage. If the vehicle owner is not satisfied with the administrative hearing, the appeal process available to him would be through the Permit and License Appeal Board in accordance with the City ordinance creating such a Board. There being no discussion from members of the industry present in the Council Chambers, the motion was made by Councilman Aderton, seconded by Councilwoman Baker to pass Ordinance No. 8203 on first reading.
