80-39A-557-775 Al Couch, Chairman of the Civic Centers Board, to appear to present the
( 9) following items:
a. Consider recommendation regarding planter boxes on the Civic
Center grounds.
At the July 15 meeting, the Civic Centers Board discussed the
need of placement of plant material in the planter boxes in
front of the Civic Center. The Parks and Recreation Department
indicated that the total project would cost in the vicinity
of $23,000, and recommended low -maintenance evergreens as
opposed to annual flowers.
Mr. Al Couch, Chairman of the Civic Centers Board, appeared to
make this recommendation indicating the Parks and Recreation
Department had indicated that there was available $20,000 from
Revenue Sharing Funds, which would be available on October, 1980;
and the Civic Centers Board approved the $3,000 to be applied
for this project.
The motion was made by Mayor Pro Tem Henry, seconded by Council-
woman Baker to accept the recommendation of the Civic Centers
Board for planting low -maintenance evergreens in the planter
boxes on the Civic Center grounds, to be funded by $3,000 from
the Civic Centers Board and $20,000 from the Revenue Sharing
new entitlement period, if available on October, 1980. Motion
carried: Mayor McAlister, Mayor Pro Tem Henry, Councilmen
Brown and Aderton and Councilwoman Baker voting Yea; none
Nay.
b. Presentation of 1980-81 budget for Civic Lubbock, Inc.
In December, 1979, the City requested the Civic Lubbock, Inc.
prepare and submit,a budget for,,the enduing fiscal year.
The ,budget, as submitted, indicated a total projected revenue
for 1980-81 to be $162,900; total expenditures is $129,300
for an excess of $33,600. Additionally, Civic Lubbock
pays quarterly to the City of Lubbock 7% of the gross
concession sales, which would amount annually to $31,000.
Furthermore, under the new agreement Civic Lubbock is
required to pay building rental for events. which it co-sponsors,
said rent being estimated for the 1980-81 fiscal year of
$25,800, for a total payment to the City for 1980-81 of $90,400.
The proposed program for 1980-81, which Civic Lubbock would
co-sponsor, is as follows:
1. Gilbert & Sullivan, Musical --April, 1981
2. Fred Waring & the Pennsylvanians --February 20, 1981
3. Summer Productions --Summer of 1981
4. Harlem Globetrotters --January 30, 1981
5. Lubbock Arts Festival--1981
6. Chamber of Commerce Women's Division

10. Army Field Band
11. Miscellaneous
(The proposed budget as submitted is on file in the Office of
the City Secretary.)

Additionally, the Civic Lubbock, Inc. Board requested an
additional full-time person to assist with the bookkeeping
of the Corporation's books. The City Staff is apprehensive
as to the wisdom of this appointment for the reasons that
there exists, under the City Budget, a sufficient staff to
assist with these bookkeeping duties with the proper planning,
organization, and delegation of duties to do so. It was
the staff's recommendation that rather than the Civic Center
Board employ a full-time person, that such funds be transferred
to the City Budget to be applied toward the present staff,
which would allow for proper supervision by the City Personnel
Department. Mr. Couch indicated this discussion had resulted
since the Civic Lubbock Board meeting, but felt that it would
be amenable to all.
The motion was then made by Councilman Aderton, seconded by
Councilman Brown to adopt the budget as submitted, transferring
$13,764 to the City Budget as recommended by the City Manager
for use of current personnel to assist with the Corporation's
bookkeeping duties; and for the City Manager;to work out the
mechanics for the employment of clerical assistance for the
Corporation's duties. Motion carried: Mayor McAlister, Mayor
Pro Tem Henry, Councilmen Brown and Aderton and Councilwoman
Baker voting Yea; none voting Nay.
80-39A-558-776 Mr. Willie Lorenz to appear to request Avenue H and Texas Avenue to be changed to two-way
(10) streets.
Appearances: Willie Lorenz
Jack Cauthran, on behalf of West Lumber Company,
2506 Avenue H
Stan Stanford (Stanford Auto Sales, 25th & Texas)
Mr. Willie Lorenz owns a service station at the intersection of 24th Street and Avenue H,
and appeared to request the Council to reconsider the one-way traffic flow on Avenue H
(north) and Texas Avenue (south), requesting they be made two-way streets again for the
reasons that the change in traffic flow has affected his business the traffic is now a
virtual freeway; that speeds are of such great intensity that it does not allow f'or GO -
street parking or turning into his place and others located in the same vicinity; that
safety conditions are practically nil for motorists; that the heavy traffic is from 7:30
to 9:00 a.m., during the noon hour, and from 4:30 to 6:00 p.m., which have been his prime
time for doing business; that the one-way traffic on Texas going south has eliminated any
evening business whatsoever.
Mr. Lorenz's summation requested that Avenue H/Texas be returned to a two-way traffic for
the reasons expressed above. In response, Jim Bertram, Director of Planning, indicated
that historically the one-way pair was projected and recommended by the Highway Department
to coincide with the constructed underpass at Avenue H/Texas and 4th Street, and was
recommended as a means of providing rapid traffic flow through the central business area
at the prime time in the morning and evening hours. Admittedly, the speed limits have
been excessive and other agenda items to be considered will speak to this problem. Mr.
Bertram further said that the Urban Transportation Plan was submitted in 1967, revised in
1970 recommending the one-way pair corridors, was supported by City Council action (Resolution)
in 1973 and has recently culminated with the construction of the referenced underpass.
Mr. Lorenz requested the Council allow other small businessmen, present in the Council
Chambers, to speak. Mayor McAlister indicated this was not a public hearing and others
could be allowed to speak only by the CONSENSUS of the Council to do so; permission was
granted. Mr. Stanford's comments indicated that both streets were virtual death traps;
that parking was hazardous; that there were abundance of tickets being issued for parking
and speed violations to the extent that it was a virtual "rip-off", and he;emotionally
appealed to the Council to reconsider their previous decision and reinstate' two-way traffic
on both Avenue H and Texas.
Mr. Cauthran's comments were of a similar nature and stressed the consideration to the
small businessmen located on these streets at these various intersections indicating it
was "squeezing them out."
Councilman Aderton queried whether or not there could be any consideration in changing the
signalization or signs on the respective streets to reduce speed the areas of the small
businesses providing a remedy other than citation by ticket and allowing the outside lanes
on each street being designated at a slower speed and allowing turning into the respective
businesses --could such a study be made to alleviate some of the problems in which these
businessmen find themselves, to which Mr. Bertram responded that a study could be made
since both streets had a number of lanes and this would not deter the traffic flow through
the central business district, but would allow motorists wishing to merge into the traffic,
turn into a business area or park curbside to do so.
Following all discussion, the motion was made by Councilman Aderton, seconded by Mayor Pro
Tem Henry that the Staff conduct such a study as referenced above, primarily to consider
establishing the outside lanes for turning, parking, and merging of traffic; to leave the
one pair corridor as presently in effect, and to delay any further decision until the
study is completed. Motion carried: Mayor McAlister, Mayor Pro Tem Henry, Councilmen
Brown and Aderton and Councilwoman Baker voting Yea; none voting Nay.

80-39A-560-779 Ordinance No. 8074
(14)
An ordinance annexing land generally described as Lots 23 thru 27, 82nd Acres Addition, to
the City of Lubbock.
The proposed ordinance is a result of Council's instructions in accordance of a public
hearing held on July 10, 1980.
Mayor McAlister indicated that Mr. Frank Patenotte, owner of the lots in question, had
requested to appear before the Council.
Mr. Patenotte gave somewhat of a historical background similar as to what was presented at
the public hearing, to the effect that when he appeared before P&Z, only Lot 25, sold to
Mr. Pete Hale, was requested to be annexed; that subsequently, he learned that all of the
above referenced lots had been submitted for annexation, and although the law did not
require he receive specific notice to this effect, he was unware of the proposed annexation.
He expressed his apologies for not appearing at the public hearing to speak on his behalf
and appreciated this opportunity to do so.
Mr. Patenotte's objection to the proposed annexation specifically relates to Lots 26 and
27, which front on Avenue F and are not subject to the City utilities, and therefore would
not be beneficial at this time, from his point of view, to be annexed to the City; that
only Lot 25, sold to Mr. Hale, will benefit from the availability of the present City
utilities, and annexation particularly of Lots 26 and 27 will create additional cost to
him and requests that they be deleted from the proposed annexation.
Mr. Bertram's response was to the effect that to comply to the annexation guidelines of
eliminating one -lot annexations, the guidelines provide annexing 600' from a thoroughfare
(U.S. 87) and it was the staff's recommendation, approved by the Council following the
public hearing on July 10, that variations from this policy should be avoided to eliminate
establishing a precedent that could come back to haunt the Council. Mr. Bertram also
indicated that the original annexation of the entire corridor was discussed before P&Z,
but altered as a result of the public hearing, the Council issuing instructions for the
staff to study all corridors into the City and related annexation recommendations. This
will be completed in the Spring of 1981.
During the discussion that ensued, Mr. Patenotte offered a compromise whereby Lots 26 and
27 would be excluded and Lots 21 and 22 be included. This presented a problem due to the
fact that the public hearing was held on Lots 23 thru 27 and the Council by law is permitted
to consider annexing less land than that on which the public hearing was held, but is
precluded from considering additional land that was not included in the advertising/public
hearing. Mr. Patenotte indicated that one of the problems with the proposed annexation is
that it is taxable ground, but not serviceable ground and he needed some relief in this
regard.
At the conclusion of the discussion, the motion was made by Mayor Pro Tem Henry, seconded
by Councilman Aderton to drop Lots 26 and 27 from this proposed annexation, WITH THE
UNDERSTANDING that the staff will consider in a future annexation the inclusion of Lots
20, 21, and 22 in compliance with the current annexation policy of annexing land 600' from
a major thoroughfare. Motion carried: Mayor McAlister, Mayor Pro Tem Henry, Councilmen
Brown and Aderton and Councilwoman Baker voting Yea; none voting Nay.

80-39A-562-783 Consider revision to the Street Paving Program of the 1979-80 CDBG.
(18)
The 5th Year Community Development Program Paving Project included widening and paving
Municipal Drive from Ash Avenue to Amarillo Highway. The projected cost was estimated at
$109,000. Due to the anticipated industrial growth in this area, the widening was increased
from 36' to 42'; the estimated cost was likewise increased to $222,967. It is a possibility
that this specific street will be included in the 1-27 Project and would be improved at that
time; additionally, there are no funds in the 6th Year Contingency Funds ($37,518); it is,
therefore, recommended by the staff that this item be deleted from the 5th Year CD Street
Paving Project (1979-80).
The motion was made by Councilman Aderton, seconded by Councilwoman Baker to delete the
above referenced item from the 1979-80 CDBG Paving Program. Motion carried: Mayor McAlister,

80-39A-566-791 Consider request of LCC Institute of Water Research regarding sewage effluent project.
(24-A)
At the 8:30 Work Session, the Council was apprised of the predicament in which the LCC
Institute of Water Research found itself with regard to the sewage effluent project at
Wilson. Pursuant to City Council action on July 10, 1980, $150,000 of the Sewer Reserve
Fund was authorized to be applied to the overrun of the construction grant for the referenced
project. The total amount involved is $623,398; the balance of this amount was to come
from EPA funds; the Institute had been assured these funds were available and had been
approved.
The predicament is this: Subsequent to the July 10, 1980 meeting, the Institute was
notified that there were no EPA funds available; that failure to fund the entire amount
would result in terminating the project; that there is no flexibility in the grant itself
whereby monies designated for research purposes could be reallocated to construction cost;
therefore, the decision for the Council is whether to proceed with the project funding the
entire amount or,, in the alternative, decline to fund the entire amount thus terminating
the project.
Questions discussed by the Council are: Can the City afford to terminate the project?
Can the City afford to underwrite the entire sum of $623,398? Is it possible for the City
to fund $300,000 from the Sewer Reserve Fund, eliminating $323,398 by nonpurchase of
additional sprinklers and curtailing the crops study's portion? Is it possible to fund
the entire sum by allocating $300,000 from Revenue Sharing Funds, $323,398 from the Sewer
Reserve Fund?
Councilmen Brown and Aderton expressed the situation clearly, to -wit: "This is a textbook
example of what can happen when you get involved with the Feds; you get caught in a situation
where you can go neither forward nor backward."
The unanimous opinion of the Council was that the City could not afford to let the project
567
Following extensive discussion and presentations by both staff and LCC
Institute representatives, the motion was made by Councilman Brown, seconded
by Councilman Aderton to (1) approve the expenditure of $323,398 from the
Sewer Reserve Fund, and to allocate $300,000 from Revenue Sharing Funds
from the new allocation in October, 1980, (if any); if none are available,
the $300,000 to be allocated from the Sewer Contingency Fund; (2) to pursue
the grant application seeking reimbursement for the City's portion; (3)
comply with the legal mechanics of contractual documentation regarding the
construction -supervisory -funding aspects of the project to assure that as
the City needs to deliver effluent to the Wilson site, the amount delivered
will be taken; that as effluent is needed by the City for other purposes
and cannot be delivered to the Wilson site, that the City not be required
to pay a penalty or royalty to the Institute; that the City enter into an
agreement with the Institute for the purchase of easements for the right to
irrigate, and the appurtenances including the storage reservoirs, supply
line and pump station, equivalent to the amount of the City's participation
($623,398); and that the City reserves the right to occupy the Wilson site
and operate it in the event of a default in the operation of the farming
project. Motion carried: Mayor McAlister, Mayor Pro Tem Henry, Councilmen
Brown and Aderton voting Yea; none voting Nay; Councilwoman Baker abstaining.
For the record, Dr. Harvie Pruitt, President of LCC, expressed words of
appreciation for the City's involvement and support in the project; additionall,
he wanted the record to reflect that the LCC Institute of Water Research Sewage
Effluent Project is a separate corporation from the College, and has its
own IRS 501(c)3 exemption status.

Consider time and date for public hearings under the Public Utility Regulatory
(25)
Policies Act of 1978, considering the standards for electric and as utilities.
Director of Sales and Services for LP&L, Carroll McDonald, appeared before
the Council and made the following recommendations in regard to the utility
hearings required by the 1978 Public Regulatory Policies Act. The hearings
will be for both electric and gas utilities, to include Southwestern Public
Service and Pioneer Natural Gas in addition to LP&L. He recommended that
the hearings be held at the Civic Center; that such hearings be held for
the electric utilities and for the gas utilities; that the recommended
dates for the public hearing for the electric utilities, to include Southwesterr
Public Service, be October 6, 7 and 8, 9:00 a.m. until 7:00 p.m.; that the
public hearing for the gas utilities (Pioneer Natural) be held on October
13; that a seven -member panel be appointed to hear the testimony, to be
presided over by a chairman of the panel who is not a representative of any
of the Utility Companies; that a court reporter be engaged to record and
transcribe the testimonies submitted, followed by the transcription being
submitted to the City Council who will sit as the regulatory authority;
that one member of the Council be representative of the entire Council and
serve on the panel; that following the evaluation of the transcript of the
testimony, the Council will then make their determination. Mr. McDonald
indicated that PURPA requires that notice be given to each rate payer, and
it is recommended that this be done by inserting a bill stuffer in sufficient
time to comply with the law, the estimated cost for this method of giving
notice to the hearings being approximately $7,500. It was suggested that
possibly the stuffer would appear in the August utility bill.
The motion was made by Councilman Brown, seconded by Mayor Pro Tem Henry to
accept the staff's recommendations, as stated above, stipulating that the
seven -member panel be comprised of two representatives from LP&L, two
representatives from Southwestern Public Service, two representatives from
Pioneer Natural Gas, and Councilman Aderton to represent the City Council
on the panel; that the representative on the panel be determined by their
respective utility company; that an official court reporter be engaged to
record and transcribe the testimony, and authorizing the notice of the
hearings through a bill stuffer to appear in the August utility bills. The
motion was amended to include the dates of October 6, 7 and 8 for the
electric hearings and the date of October 13 for the gas hearing. Mayor
Pro Tem Henry approved the amended motion. Motion carried: Mayor McAlister,
Mayor Pro Tem Henry, Councilmen Brown and Aderton and Councilwoman Baker
