(11)
An ordinance calling a bond election.
By consensus the Council permitted Victor Cargile of 2216 8th Street
to speak on this matter before second reading.
Mr. Cargile expressed concern over the use of the proposed bonds
questioning the need of the projected construction of a reservoir; he
recommended more use of the Canadian River water, thus preserving the
water supply in the Sandhills Well Field; he inquired whether or not
government funding was available for these projects and expressed
related concerns.
Councilman Brown, being a member of the Water Resources Board who
recommended to the Council that a bond election be called for the
purpose of water improvements to the existing system, responded to the
effect that the total usage allowable to the City of Lubbock from the
Canadian River Water Authority is utilized to its maximum; that the
reservoir of the Authority is at its capacity as related to the total
water shed in that area; that the Sandhills Well Field is not being
totally
otally utilized, it being necessary to construct new wells every few
years to achieve the maximum usage of the water supply; that new
distribution lines are needed to serve the newly annexed areas in the
City; that improvements and expansion of the present water treatment
system is necessary to provide for additional storage and continuity
of distribution of the present system; that this proposed bond election
is not related in any manner to the Post-Justiceburg projects to be
considered in the future; that no funds are available for these
improvements; that the purpose of the bond election is to submit to
the voters their support, or denial, of the improvements on the referent
water projects which are urgently needed for the City.

Ordinance No. 8057
An ordinance establishing duties and responsibilities of the Board of City Development.
By consensus the Council permitted Steve McIntyre to speak on this matter; Mr.
McIntyre appeared on his own behalf.
Mr. McIntyre presented an involved historical background as to the creation and
operation of the BCD, reflecting there was definitely an anglo power structure at
the base of these actions; Mr. McIntyre took exception to the provision under
Section 3(c) Ila candidate shall have demonstrated good judgment in his or her
business or profession", to which he responded that this excluded minorities
altogether, as a success in their businesses and professions; that the matter of
considering this ordinance had been handled in a deceptive and "hushed -up" manner,
to which City Attorney John Ross responded in a most positive way, stating that the
agenda had been posted the required 72 hours as required by the Open Meetings Act,
allowing Mr. McIntyre and other citizens adequate time to peruse the materials at
hand and to make the appropriate inquiries on any item appearing on the agenda, and
Mr. Ross further objected to the insinuation that the Council was handling matters
in an indiscrete, "hushed -up" manner. In response to Mr. McIntyre's insinuation
that these requirements were not required of other boards, Mayor McAlister responded
that there were requirements made of other boards and commissions, if he was acquainte(
with these respective ordinances.
There being no further discussion, the motion was made by Councilman Brown, seconded
by Mayor Pro Tem Henry to pass Ordinance No. 8057 on second and final reading.

ORDINANCE NO. 8057
AN ORDINANCE SPECIFYING THE DUTIES OF THE -BOARD OF CITY DEVELOPMENT,
METHOD OF APPOINTMENT OF BOARD MEMBERS, QITLIFICATIONS OF MEMBERSHIP
AND AUTHORIZING THE BOARD TO CONTRACT FOR SERVICES
Resolution No. 512
Consider approval of contract between the Board of City Development and the
Lubbock Chamber of commerce, and authorize same.
The proposed contract is between the Board of City Development and the Lubbock
Chamber of Commerce setting out the various terms and conditions for the transaction
of business between the two organizations; the Council felt this contract was
necessary inasmuch as taxpayers' monies are involved in the operation of the BCD.
Councilwoman Baker moved that the referenced contract be approved with the following
changes:
1. In Article I, it is to read "...It is recognized and agreed that the
Chamber and Board of City Development, consistent with the duties
they herewith undertake, shall have full latitude and sole discretion
in selecting and determining programs, priorities for programs and
methods utilized for attempting to perform said programs..."
2. That there be inserted a default clause, the wording to be prepared by
the City Attorney.
3. That Article VI entitled "Bond" be inserted to read as follows:
"The President, Secretary, Treasurer of the Chamber shall each give
an official bond in the sum of TWENTY-FIVE THOUSAND DOLLARS ($25,000.00).
The bonds referred to in this paragraph shall be conditioned for the
faithful discharge of the duties of each such officer in reference
to the obligations assumed under this contract and for the faithful
accounting of all monies and things of value coming into the hands
of such officer as a result of this contract. The bonds shall be
procurred from some regularly accredited surety company authorized
to do business in the State of Texas. The premiums therefore shall
be paid by the chamber from the consideration it receives under this
contract. A copy of each officer's bond shall be filed with the
City Secretary.
417
The motion was seconded by Mayor Pro Tem Henry.
There ensued a brief discussion as to the conflict of Article VI with tl
fact that all members of the BCD are bonded automatically; Councilwoman
Baker's response was to the effect that in the event that the officers
of the Board of City Directors and the officers of the Chamber of
Commerce were not the same parties, this could be detrimental in
developing the programs for the good of the City; that it was most
unlikely this would occur,,but in the event it should, this would be
binding upon the parties involved.
At the close of the discussion, a ballot was taken: Motion carried:
Mayor McAlister, Mayor Pro Tem Henry, Councilmen Brown and Aderton
and Councilwoman Baker voting Yea; none voting Nay.
