The program consists of requiring an international resident of Lubbock to visit ten different citizen groups and filing a report of each visit with the appropriate member of the Chamber of Commerce. Miss Chung has completed these requirements. Mr. Bill Armstrong, member of the International Citizenship Program Committee, made the presentation; also present was Ms. Jackie Berens, who proposed the program on behalf of the Chamber. 80-39-300-441 Cynthia Wynn to appear to request City Council approval of grant applicat (16) for Summer FoodServiceProgram for Children. At the Work Session commencing at 8:30 a.m., City Manager Larry Cunningham indicated that the prepared remarks of Ms. Wynn had been presented to him at 5:00 p.m. on the 23rd, and he distributed these remarks to members of the Council. Appearances: Cynthia Wynn, on behalf of Trinity Ministries Garnet Reeves Gail House, member of the Trinity Ministries Advisory Boa Texas Tech Professor Adolphus Cleveland, Minister, Baptist Church Sister Regina Froppe Mr. Garcia Esther Sepeda Pat Nickell, President, League of Women Voters Jodi Wartes, a single parent Becky Peterson, President, Church Women United Greta Wood, Social Services Coordinator (Hub Homes and Green Fair Manor) Ms. Wynn appeared on behalf of the Trinity Ministries indicating that the deadline for the program was April 30, and indicated there were no funds available for the program in the event the Council did not approve said program; that the program had been administered by the Parks and Recreation Department for the last three years, very successfully, and there was a need in the immediate area for the free lunch program; that the majority of the children were from single -parent families or both parents were working and were categorized in the low-income area; that the program not only provided a free lunch for these worthy children, but enhanced the playground program. She also indicated that she agreed the program needed to be carefully monitored, with each child "signing in" each day, and it had been her observation in past years that there was very little waste. Mr. Reeves's comments indicated that there was great benefit to the children in this program as it is related to the playground activities; that his own child had benefited from the Parks and Recreation Playground Program, and urged reconsideration of this lunch program. Ms. Gail House addressed the need for establishing a task force of some source for next year's planning and reorganizing the program in the future; that lack of approval of this program would penalize the children in the area, and the need for discontinuing said usage of federal funds should be applied to "things" and not "people"; she asked the Council to reconsider their decision. Mr. Cleveland's comments acknowledged the need for cities being independent of federal funding, but advocated the philosophy should be practiced, "across the board" and not isolating specific needs as it relates to people in this area; that the Council's action infers an "anti -poor" and "anti-negro" approach to this principle in practice. Mr. Garcia indicated that the earning capacity for residents in the areas in question are minimum and most families are having difficulties making ends meet; he additionally felt that the minority representatives not only are affected, but deserve equal opportunity in making decisions affecting their destiny. 301 Sister Regina remarked she had observed the program in progress over the past years, and it served a very definite need in the area; that most mothers are working and most residents are in the low-income category; she urged reconsideration of this program. Ms. Sepeda indicated she had served on various boards and commissions in the City, and had great concern for the increase in juvenile delinquency in these areas, which are the highest juvenile delinquency ratings in the City; that such a food program should be reconsidered and enacted with the thought that it would curtail juvenile delinquency, which should be given priority consideration in all matters; she urged the Council to start their economizing in relationship to "things" rather than 11people". Pat Nickell appeared on behalf of the League requesting reconsideration of the program and expressed endorsement of such a program for the immediate summer; she concurred that alternate funding should be considered for the future. Ms. Wartes' appeal was as a single parent and the need for such a program on the playground and the free lunch program was beneficial for her children; she indicated she would be willing to subsidize such a program by providing funds for her children's lunch, although she did not have an abundance of income and was receiving no child support; however, she did agree as to the need of subsidizing the program by those who were able to do so. Ms. Becky Peterson, on behalf of Church Women United, endorsed the free lunch program administered through the Parks and Recreation Department indicating that a screening process would be essential for sound administration of the program and she, too, would be in favor of the churches of Lubbock underwriting such a program for the future. Ms. Wood reported as to the need for such assistance in the Hub Homes/Green Fair Manor areas in which her work predominately is situated; that all residents in her areas are in the low-income category and such'a program in her areas have been utilized to teach children table manners, cleanliness as well as assist the families in their struggle with inflationary problems relating to food. Councilman Aderton responded to the above comments indicating he had voted against the program at the April 10, 1980, Council Meeting, but he did admit that there had been sufficient evidence presented since that time that had given him cause for second thoughts. He felt very strongly that the program should not be the responsibili of the City; that there were too many social service organizations that could underwrite such a program and administer it, for example, there are 350 churches in the City and each church could be assessed per capita (approximately $130 per church); that such an undertaking would need to be carefully planned and administered, but it was a definite possibility; he also felt the responsibility of working parents, that where possible, they contribute and/or subsidize the program by allowing their children to pay the minimum amount; that there was great possibility of such a program being abused, and although it was designed for the younger children and those in need, he questioned why 18-year-olds were allowed to participate when they should be working if jobs are available, they are allowed to vote, they are allowed to drive and they should be considered adults and conduct themselves as such. Councilman Brown indicated he had voted against the program at the April 10, 1980 meeting and would do so at -this time; that he had strong convictions against federal funding for such matters as this;''that this was nothing but "creeping cradle -to -grave socialism" and it is not the responsibility of the City; that somewhere, sometime, and some way we must begin to require people to stand on their own feet. Mayor McAlister commented on his concern being control of the program --monitoring of the participants, eligibility of the participants, the effectiveness of the program as it relates to the playground activities administered by Parks and Recreation Department: that those parents who were able to do so be allowed to donate or subsidize the program if their children are participants. Mayor Pro Tem Henry indicated he was impressed by the amount of volunteer citizen support, and could see the need that it would serve; however, he still had not heard any statistics that indicated the effectiveness or impact the free lunch program had on the playground activity program and would like to have this information at some time; that in the event it is not available in the past years that it be compiled and presented after the ensuing summer program is completed; that he personally would be in favor of extending the program for one more summer, subject to planning for the future using other funding. Following all discussion, the motion was made by Mayor Pro Tem. Henry, seconded by Councilman Aderton to extend the program for one more year, and authorize submission of the grant application for the necessary funds; that the program be closely monitored of all participants and their eligibility; that parents be given an opportunity to donate to the program if their child is a participant; that volunteers be used where possible; that statistics as to the effectiveness of the program as related to the playground activities be compiled, that is effectiveness on the crime rate, etc.; that it be clearly understood that in the interim, another organization to assume the responsibility of planning, monitoring and administering the program for 1981 be considered; and that the grant application be submitted on or before April 30, 1980, deadline. At the April 10, 1980, City Council Meeting, the Council expressed some concern regarding binding wrecker service fees; The Legal Department has reviewed the above ordinance and it is their opinion that the fees stated in the ordinance are binding on wrecker services providing a particular service covered by this ordinance --pick up and impoundment of abandoned and/or illegally parked vehicles within the City --and does not pertain to normal wrecker "collision" calls, which should be regulated by a comprehensive wrecker ordinance. Such a comprehensive wrecker ordinance is being prepared and considered by the Legal Department at this time. Following consideration of this ordinance at the April 10, 1980, City Council Meeting, several members of the Council have been contacted by the PTA at MacKenzie Jr. High School and Rush Elementary School. By consensus, the Council agreed to allow those present in the Council Chambers to appear and speak to the matter at hand. Appearance: Dr. Bruce Bartholomew, on behalf of the MacKenzie Jr. High and Rush Elementary PTAs Dr. Bartholomew commended the Council for empathy as demonstrated in their consideration of the summer food program and compared the matter at hand with the previous item considered, i.e, the concern for the safety for the school children at the MacKenzie and Rush Schools and the need to reconsider allowing the blinking lights to remain in force and effect. Mayor McAlister acknowledged the prepared comments submitted by Mrs. Bateman, President of the MacKenzie PTA, in which she made comparisons with other school zones in effect throughout the City, and submitted statements of support of their request signed by parents and members of the respective PTAs. Director of Planning Jim Bertram responded to her comments to the effect that the comparisons were erroneous, with the exception of Bayless Elementary School, in that the school zones referred to were not contiguous with the traffic signal installed on Slide; thus did not cause confusion to the vehicular traffic in the particular area. (24) The purpose of this hearing is to receive and consider public input regarding the changing of citibus fare, establishing an exact fare policy in the interest of public safety and efficiency, replacing the $3.50 pass with a prepaid punch card at a 20% discount. Dr. Melton Smith, President of the Transit Advisory Board, appeared before the Council, and on behalf of the Board made the following recommendations: 1. It is recommended that a change in the fare plan on Citibus be implemented, the change being primarily in structure more than increase in fares. This would be done by using prepaid tickets, i.e. 40j per ride for adults, 30 per ride for students, 254 per ride for senior citizens/handicapped, adults riding on the bus would cost 5U per ride. 306 2. It is recommended the discontinuance of the weekly pass which previously had been purchased from the driver on the bus. This would result in a saving in printing cost inasmuch as the weekly passes were dated and usage of same had become abusive. 3. It is recommended that the policy of bus drivers making change on the bus be discontinued, i.e. the driver would carry no funds whatsoever. The new proposal would allow him to receive funds in two denominations (25j, 50), but would discontinue the practice of'making change for riders. It was the Board's analysis that the above recommendations would increase ridership, which has already been reflected in recent weeks, and would increase the revenue. The above recommendations would be implemented in three phases: I. Qualifying individuals for discount fares with photo identificatic cards. This phase was implemented February 1, 1980, with the senior citizens/handicapped individuals. II. The prepaid fare system would be utilized through punch cards sol in ten -ride and twenty -ride formats purchased from various mercha banks, schools, costing $3 and $6 respectively. The student pric (30J per ride) would be available to all full-time students, to include the Texas Tech student body, commencing August 18, 1980. Yellow punch cards would be used by the general public under this phase. III. Implementation of this phase would be timed with the introduction the advanced design buses expected to be in operation in September 1980. The full fare on Citibus would be raised to 501. The transfers are to'remain free consistent with the current policy. Dr. Smith recommended that the Board's recommendation be accepted and approved. There being no discussion and no opposition, the hearing was closed. The motion was made by Councilman Aderton, seconded by Councilman Brown to approve the above recommendations of the Transit Advisory Board, and to authorize the phasing plan as presented. In accordance to Notice published in the Lubbock Avalanche -Journal on April 8, 1980, a Public Hearing was held on the above matter. This request is to convert an existing house into office use, and was approved by P & Z by a vote of 6-1. Proponent: Bill Miller Mr. Miller indicated he had purchased this house as a residence prior to the establishment of Post Plaza, which was zoned for mixed development -- hotels, banks, and retail uses, to include a double -deck parking building. Subsequently, this area has not developed as zoned, and the proponent finds that the area is no longer suitable for residential for his personal use or marketable as residential for anyone else's personal use. The nature of his business is consultant to trucking firms which requires very little foot traffic, most of the business being conducted by telephone His comments were for the purpose of clarifying the increased traffic flow concept which might be inferred. He indicated necessary parking for his uses would be at the rear of the premises. . There being no opposition and no discussion, the hearing was closed. The motion was made by Councilman Brown, seconded by Councilman Aderton to approve the referenced request, and to pass Ordinance No. 8041 on first reading. In 1976 the United States Supreme Court handed down a decision in favor of cities through a decision of the National League of Cities vs Usery in a determination of the Federal Minimum Wage and Overtime provisions under the Fair Labor Standards Act. Subsequently, the Department of Labor has developed procedures to enforce the application of FLSA provisions to municipal employees in "non-traditional" areas of municipal involvement and services. This kind of ruling would be very costly to the City and to many other municipalities throughout the country. It is the recommendation of the staff that the referenced resolution be passed expressing the opposition of the City Council and that copies of the resolution be distributed to the President's representativ Senators Bensen and Tower, Congressman Hance, to the National League of Cities, and to the Texas Municipal League. Usery determined that federal minimum wage and overtime provisions of the Fair Labor Standards Act could not constitutionally be applied to local government employees, and WHEREAS, the U.S. Secretary of Labor has now promulgated procedures to enforce application of the FLSA provisions to city employees engaged in what the Department of Labor has determined to be "non-traditional" areas of city involvement in services, including the operation of electric utilities and bus services, and WHEREAS, the City of Lubbock has operated an electric utility for more than 50 years and has been forced in recent years to assume the operation of a transit system for its citizens, NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the question of applying the FLSA to city employees was settled by the U.S. Supreme Court in 1976 and the Department of Labor's recent ruling on "non-traditional" functions is without legal basis and such ruling should be suspended immediately pending public review and comment, and THAT the Department of Labor's ruling will impose substantial costs on the City of Lubbock and will result in increased utility costs for Lubbock citizens in addition to generating a highly inflationary effect at a time of already enormous inflation and energy costs to this nation's citizens, and THAT whether a function is "traditional" or "non-traditional" is not a question to be left to the Department of Labor bureaucrats for decision, since the courts already have spoken on that issue, and W. I THAT continued federal interference in municipal services is totally unacceptable to the City of Lubbock and further is totally inconsistent with the duty to provide the most efficient delivery of government services possible to our citizens, and THAT the Department of Labor's ruling adds to the already nearly intolerable burden of meeting multitudinous federal mandates and the City of Lubbock is willing to take whatever action is necessary to see that the Department of Labor abides by the decision of the U.S. Supreme Court, and THAT a copy of this Resolution is to be sent to President Jimmy Carter; Jack Watson, special assistant to the President; U.S. Senators Bentsen and Tower; Congressman Hance; the National League of Cities; and the Texas Municipal League. Motion curried: Mayor McAlister, 330 APR 2 4 1980 Pursuant to Council reconvening at 2:30 p.m., the following item was considered. 80-39-330-485 Bid No. 5809 for seven trucks (Sanitation Department). (56) The low bidder in this matter was South Plains International Truck Company ($239,908.31), with Plains Truck Center (Ford) being the second low bidder ($249,298.00). South Plains indicated they would not have a delivery date until October 15, 1980; Plains Truck Center indicated their delivery date would be on or about August 1, 1980. The concern of the staff is that the projected delivery date of South Plains would require continual maintenance on the existing equipment which has become a very expensive item, and the earlier delivery date (Plains Truck Center) would save approximately $19,765.31. A telephone. call to Messrs. Kubacak and Summers with Plains,Tr,uck Center revealed that they could not guarantee delivery on or about August 1, 1980, as indicated in the specification; therefore, the staff reported to the Council that it was their recommendat to recommend the low bidder --South Plains International Truck Company. The motion was made by Councilman Brown, seconded by Councilman Aderton to approve Bid No. 5809 for seven trucks for the Sanitation Department, with low bidder of South Plains International Truck Company. In accordance with a Notice posted, a public hearing on the above referenced matter was continued. Mr. Jim Brewster, Trial Attorney for the City, presented to the Council the following fact pattern: 1. On November 23, 1979, the South Plains Electric Cooperative, In filed with the City a rate application for a change and increasel— t of 331 of rates charged its customers in its certified territory which lies within the corporate City limits; 2. That under the terms of the Public Utility Regulatory Act, the governing body of any municipality which has not surrendered such control, is the authority for the determination of utilities rates; 3. That in accordance with Article 1446-c, on December 20, 1979, the Council, by resolution, suspended the operation of such proposed rate schedules for a period of 120 days beyond the date on which such schedules would otherwise have gone into effect; 4. That pursuant to Article 1446-c, on December 20, 1979, the City Council set a public hearing upon the rate application to commence on January 24, 1980, subsequently continued until April 24, 1980. The rates proposed by South Plains Electric Cooperative, Inc., in their package - application, was modified in their letter of April 2, 1980, resulting from changes" imposed by the PUC as not unreasonable as the term is defined in Article 1446-c, as the rates apply to customers of South Plains Cooperative, Inc. within the City. The staff's recommendations are: 1. That the rates as modified by letter dated April 2, 1980, are not unreasonable as the term is defined in Article 1446-c insofar as they apply at this time to the customers residing within the City of Lubbock; and the City Council's action, sitting as the regulatory authority of the subject under consideration, acts in this capacity only, and not that of the City Council of the City of Lubbock, and does not waive any claim of the City in matters of litigation between the parties, now pending; 2. That the Regulatory Authority, upon the evidence as filed in this proceeding, finds only that the proposed rates of South Plains Co-op, as modified in a letter dated April 2, 1980, affecting that territory within the corporate City limits pertaining to the customers of South Plains Co-op only, are not unreasonable; 3. That the Regulatory Authority, by resolution dated December 20, 1979, suspended operation of the proposed rate schedule for 120 days, and by that revocation of same would allow a system -wide modified change by placing in effect the South Plains rolls, as modified. Additionally, this would set no precedent for future rate applications, as interpreted in Article 1446-c. Additionally, past rates have been set by ordinance for all utilities; special bulk rates still remain in effect until such time as modified under the new procedures by the PUC. This action today would not be considered enactment of these rates; however, as all rate matters are maintained on an ordinance -basis, these could be incorporated similarly in cooperation with South Plains Co-op. Mr. Dale Johnston, attorney on behalf of South Plains, responded that they appreciate the cooperation of the City; that the PUC adopted almost the total rate application - package filed in this matter with few modifications; and he, too, asked for the same waiver and disclaimer regarding matters of litigation presently pending. In response to Council query, this action will remain in effect until such time as the PUC agrees the rate can be changed. There being no further discussion and no opposition, the hearing was closed. The motion was made by Councilman Aderton, seconded by Councilman Brown to accept the staff's recommendations, as referenced above. Motion carried: Mayor McAlister, Councilmen Brown and Aderton voting Yea; none voting Nay; Mayor Pro Tem Henry absent from Council Chambers. The Regulatory Authority of the City of Lubbock adjourned at 3:25 p.m. 332 The City Council reconvened immediately thereafter, and upon motion by Councilman Aderton, seconded by Councilman Brown, the meeting adjo at 3:30 p.m. Motion carried: Mayor McAlister, Councilmen Brown and Aderton voting Yea; none voting Nay. nLI, MCALISTER, MAYOR ATTEST' - Evelyn Gaffga, City See/re6rereasurer READ AND APPROVED ON THIS 8th DAY OF MAY, 1980. Bftf -9CALfSTER, MAYOR ATTEST: Evelyn Gaffga< 61ty-41 ary-Treasurer 6
