A problem was created by platting a portion of a large storm water storage and drainage easement into lots. Lakeridge County Club originally platted a large area into this easement, but when they platted the adjacent land, the plat encroached on the easement. The plat was approved September 15, 1984 and the cut and fill was approved prior to the plat date with this development in mind. The approved plat did not consider the need to abandon a portion of the easement and was found when a permit was applied for on one of the lots. A $150 application fee was received and there is no charge for the land - originally dedicated the easement. This action will correct the problem and Staff recommended approval. Monroe, Assistant City Attorney On November 5, 1886, Mayor McMinn, Councilman Nash, Larry Cunningham, Lee Osborn, representatives of Texas Tech, and the Texas Parks and Wildlife Department, presented a plan to develop a State Historical Park at the Lubbock Lake Site. The Texas Parks and Wildlife Commission voted to construct an interpretive center for exhibits and educational programs and a research laboratory to be used by Texas Tech University for archaeological excavation and research' The rest of the area at the Lubbock Lake Site will be restored to its prehistoric landscape with self -guided interpretive trails, natural areas, parking, and picnic and rest stop facilities' 548 December 18, 1986 Prior to that meeting, the City Staff had been working with the Texas Parks and Wildlife Staff to prepare a Lease Agreement between the City of Lubbock and the Texas Parks and Wildlife Department. On September 24, 1986, Pat Campbell, General Counsel for Texas Tech University and Boyd Johnson, General Counsel for the Texas Parks and Wildlife Department, met with John Ross to review a proposed Lease Agreement. At that time, there was general agreement between the three parties that the Lease Agreement was satisfactory; however, TP&W needed to review the proposed Lease with their Staff. The City received a final draft of the proposed Lease Agreement from TP&W on Friday, December 12 and City Attorney John Ross reported that all parties are in agreement and that City Staff recommended that the Mayor be authorized to sign the final copy of the Lease Agreement. The key elements of the Lease Agreement are as follows: 1. The Texas Parks and Wildlife Department will lease from the City of Lubbock, approximately 307.3 acres which includes all the City of Lubbock property at the Lubbock Lake Site location, exclusive of the Berl Huffman Athletic Complex, the land immediately to the south of the Complex, and a buffer zone on the west side of the Complex to allow traffic circulation and access to the Complex. 2. The Texas Parks and Wildlife Department will operate and maintain this site to be known as Lubbock Lake Site which shall be open to members of the general public. 3. The term of the Lease shall be for 50 years, unless terminated early, and TP&W would have the right to extend the Lease for an additional 50 years by providing the City with a written notice of the department's intention. 4. The City shall receive, in consideration of the improvements made by TP&W and their ongoing operations of the facility, $1 per year for the Lease of the land. 5. TP&W shall pay all the operating expenses and maintenance expenses, including utilities, maintenance, and personnel cost. The City agrees to grant all utility easements necessary to serve the leased premises. 6. TP&W shall not assign this Lease or grant any sublease without prior approval by the City of Lubbock. It is intended that TP&W would grant concession agreements to Texas Tech University for archaeological services. 7. TP&W will have the right to enter any concession agreements deemed appropriate for the development and operations of the site. 8. TP&W will hold harmless and agree to defend the City against all claims or law suits arising out of the development or operations of the Lubbock Lake Site. 9. If TP&W fails to commence construction within five years, the City could terminate the Lease. 10. TP&W agrees to complete a Master Plan within 24 months and will furnish the City of Lubbock a copy of the Master Plan. The Department agrees to commence implementation of the Master Plan within 12 months. It was anticipated that once the Lease Agreement is executed between the City of Lubbock and Texas Parks and Wildlife, the Texas Parks and Wildlife Department will then execute a Sub -Lease Agreement or Concessions Agreement with Texas Tech University. It was also anticipated that the Lease Agreement will be presented to the Texas Parks and Wildlife Commission at the January meeting and that the Master Plan for the project will be presented to the Commission in April or May. A construction Contract should be awarded in the Fall of 1987 and should be completed within two years, the Fall of 1989 or the Spring of 1990.
