Harry Hoffman, Director of Transportation APPROVED AS TO FORM: m J. Worth Fullingim, Assistant City Attorney The Contract with Texas Tech for transit services is for the period beginning September 1, 1986 and ending August 31, 1987. Contract cost per hour is proposed to be $26 for ,,4+h ;% fijpi cost adjustment below or above 27) June 12, 1986 Motion was made by Councilman Carpenter" seconded by Councilman Patterson to authorizing Resolution #2339 on recommendation Of Staff. Motion carried: 5 Yeas; 0 Nays 80-45-279-378 (22.) Consider Section 12-60(a) concerning the removal or filling of abandoned underground flammable atoraog containers. ORDINANCE ORDINANCE NO. 8930 AN ORDINANCE REQUIRING THE REMOVAL OR FILLING OF ABANDONED UNDERGROUND FLAMMABLE STORAGE TANKS; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY AND PROVIDING FOR PUBLICATION. On November 20, 1980, the Council passed an Ordinance requiring the removal or filling of abandoned underground flammable storage tanks. During January through March 1983, the Fire Marshal's office sent letters to 83 owners of abandoned storage tanks informing them of the Ordinance and to indicate the need to remove or fill these areas' Since the letters were mailed out three years ago, only a small percentage Of owners have voluntarily complied with the Ordinance. At this time, the Fire Marshal's office needs to aggressively pursue those who have failed to comply with the Ordinance, including legal action if necessary, it was Staff/o recommendation that the Ordinance be revised to allow a review process before the Permit Appeals or other board designated by the City Council' The Permit and License Appeal Board would have the authority to issue an order for compliance or removal to eliminate the Violation, including placing a lien on the property for the cost of such action. The proposed Ordinance revision also includes a provision that a violation of the Ordinance be considered a misdemeanor punishable by a fine not to exceed $200. At this time, there are 124 abandoned underground flammable storage tanks in Lubbock. It was recommendation of Staff that City Council approve this Ordinance. Motionwas made by Councilman Nash, seconded by Councilman Carpenter to pass on first reading Ordinance #8930 as recommended by City Staff. Motion carried: 5 Yeas; 0 Nays 86-45-279-379 (23') Consider approval of a Liquified Mapp Gas Installation at 4005 Avenue A. Don Walker, Manager for Lubbock Welding and Supply, Inc., located at 4005 Avenue A, has requested a Liquified Mapp Gas installation. This gas is covered by the same guide- lines as liquified petroleum gas so the tank and the installation must be registered with the Texas Railroad Commission. Before the Railroad Commission will finalize their approval, approval must be granted by both the Fire Marshal and the City Council. The Fire Marshal has inspected the installation and recommended approval. Motion was made by Councilman Carpenter, seconded by Councilman Patterson to approve the installation of a Liquified Mapp Gas at 4005 Avenue 8 as recommended by Staff. ORDINANCE #8931 ORDINANCE NO. 8931 AN ORDINANCE AMENDING THE LANGUAGE OF SECTION 34B OF ORDINANCE NO. 8554, RELATING TO SALES, REPAIR OR INSTALLATION OF EQUIPMENT BY CABLE TELEVISION FRANCHISE GRANTEES; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. 86-45-282-383 (27.) Agreement Amending Gas Purchase Agree- ment in Files In response to the City Council's request for an official legal opinion on a cable TV franchise operator under Ordi- nance #8554 to retail accessories, a legal opinion was re- quested from both our Legal Staff and CTIC Associates, a non-profit consulting firm specializing in municipal cable operations. Both were in Agreement that the original in- tent and legal interpretation of Ordinance 8554 (Cable Television Regulatory Ordinance) and Ordinance #8573 (Franchise Agreement with Cox Cable, Lubbock) is that Cox Cable TV is prohibited from the sale or repair of TV and radio accessories that are necessary to make a television set operate. Remote control units, converter boxes, etc., are not necessary for the operation of the television set and are classified as cable accessories since they facili- tate the cable signal. Therefore, Cox was not in violation of the Ordinance. Section 34(b) of Ordinance 8554 will be amended to read as follows: No grantee nor any representative of a grantee shall engage in the business of selling, repairing, or installing television receivers, radio receivers, or accessories necessary for the actual operation of such receivers within the City of Lubbock during the term of a franchise, and the grantee shall not allow any of its shareholders to engage in any such busi- ness". Technical Assistance Application in Files The current supply of natural gas fuel for the Holly Avenue plant is with Gas Gathering Systems, Inc. Gas Gathering Systems, Inc- is a joint venture of Adobe Oil and Gas Company, and some local businessmen- The joint venture was established for the purpose of bringing a gas line from the El Paso Natural Gam pipeline at Levglland to the Holly Avenue plant' The Amendment reduces the price of gas to LP&L from $3.27 per mcf to $2.00 per mcf until January l, 1988. On January 1, 1988, the price of gas to LP&L will be Gas Gathering System, InC./s weighted average cost of gas plus a transportation fee of 49 cents and G fixed margin of 21 cents per mcf' Also beginning January I, 1988, the City of Lubbock would have the option to buy gas from other suppliers if gas was available at a lower coat than that offered by Gas Gathering Systems, Inc. If the City did buy gas from other suppliers, Gas Gathering Systems, Inc' would be paid (by the City) 49 Cents per mcf for transportation of that gas' Beginning January l, 1987, the City of Lubbock participates in the net income before taxes from the operation of the Gas Gathering Systems, Inc. line from LeVelland to Lubbock currently serving the Holly Avenue plant in the amount of 7-I/2%. The proposed Amendment allows LP&L to save approximately $1.9 million in the first twelve months after the Amendment' LP&L would continua at that rate of savings thorough the remaining months up to January I, 1988 and beginning January l, 1988, LP&L would have the option to buy gas at the Contract rate or if the City could buy gas at a lower price, then the City could buy from another supplier' Since the gas line from LeVelland to the Holly Avenue plant was built primarily and financed based on the revenues from Lubbock Power and Light, the Staff advised it appropriate for LP&L to participate in all business transacted through that line. The Contract offers significant savings to LP&L, and Staff recommended approval of the Resolution.
