In December, 1982, the City of Lubbock executed a 50
year lease of a tract of land in the 2300 block of
Quaker Avenue (the old Char -King Drive -In parking
lot) to E. Reuel Nash. (Mr. Nash is using this lot
for additional parking for a shopping center to the
north, including Casa Ole and Caprock Savings.) The
rent payment for the first year was for $150 per
month, with a yearly increase thereafter of $7.50
per month.
This Amendment is a result of an Easement request by
LP&L. In 1989, the City purchased approximately
five acres at 106th and Indiana for a substation. A
new transmission line will be constructed from this
substation northward along Indiana to LP&L's
existing line along the south side of 82nd Street.
At 82nd Street, this new line will cross either the
property at the southwest corner or the southeast
corner and will require an Overhead Utility
Easement.
Staff first approached John Mullins (of Mullins TV),
property owner at the southwest corner, but Mr.
Mullins threatened to tie up the purchase in court
and further stated that he does not want to
jeopardize the Lease he currently has with Eckerd
Drugs. Estimated condemnation costs for this are
estimated at $15,000.
LP&L then gave us an alternative site for the
Easement which is across the property at the
southeast corner of the intersection. This property
is owned by E. Reuel Nash, who stated that he needed
relief with regard to the Lease he has with the City
at 23rd and Quaker. Caprock Savings, his main
tenant, closed the office leaving most of the
shopping center vacant, which created an immediate
loss of income.
Mr. Nash is willing to give LP&L the Overhead
Easement at no charge, but requests a change to the
term of the Lease with the City to five years,
giving time to find another tenant and to determine
the impact the East-West Freeway may have on this
property.
This Resolution amends the original Contract to read
that for the next five years, rent will be $10 per
year for the parking lot. After this five year
period, the rent will be $150 per month for the
first year and then increase by $7.50 per month as
in the original Lease. As original Lease Agreement,
has improved the parking lot by resurfacing,
restripping, relighting, and installing new parking
bumpers.
Staff recommended approval.

Councilman Phillips to authorize Resolution #3585 as
