This is the fifth of five resolutions in the paving
assessment process. This program consists of two
units: (1) 34th Street from West Loop 289 to Milwaukee
Avenue, and (2) an alley between 61st Street and 62nd
Drive and between Louisville Drive and Kenosha Drive;
Staff recommended setting the public hearing for
December 13, 1990, at 10:40 a.m.
Thirty-fourth (34th) Street was included in the 1987
bond issue, and the alley was petitioned to be paved by
19 of the 25 owners. At the public hearing, the City
Council is to determine whether the street and alley
will be paved and to decide the amounts to be assessed
against abutting properties.
Staff recommended that the Public Hearing notification
mailings to the property owners contain enhanced value
rates for the 34th Street Project. The calculated
rates conform to State law and City policy and are
extremely high on thoroughfare projects. In this case,
the rates are $33.81 per foot for residential property
and $52.47 per foot for property other than
residential. An appraiser determined, in a value
study, that due to the proposed paving enhancement,
rates of the abutting properties would range from $15
to $24.80 per foot for the paving. In past Programs
the Council has consistently used the enhancement rates
established by the value study on thoroughfare
assessments.
Staff memo indicated that the alley paving was of
primary benefit to the abutting owners, and that
requiring all City taxpayers to fund a significant
amount of the alley paving cost would not be equitable.
In the last program, the Council required 60% of the
owners to execute an agreement stating the enhancement
November 15, 1990
Page 816

(11.)
of the alley paving equalled the calculated rate or the
alley paving units were deleted from the project.
Staff recommended that notifications of Public Hearing
to alley property owners contain the calculated rates.
Notice of the public hearing will be advertised three
times in the newspapers and additional written notice
will be mailed to affected property owners as shown on
the current tax rolls.
Motion was made by Mayor Pro Tem Baker, seconded by
Councilman Patterson to authorize Resolution #3495 and
sending notification containing enhanced rates for
residential paving and calculated rates for alley
paving as recommended by Staff. Motion carried: 7
Yeas; 0 Nays.

According to Staff memo, no operating wells exist in
Section 69. The City of Lubbock owns the surface
interest, and the Connell Estate of Fort Worth owns the
mineral interest. On Monday, November 5, Dawson
Geophysical talked to the Brazos River Authority and
referred them to the City and Jan Fouts, Attorney for
the Estate. Mr. Fouts advised that the survey could be
allowed if: 1) no explosive devices are used; 2) no
track vehicles are used; and 3) archaeological sites
are not interfered with.
This revised seismic survey is across Sections 69 and
78, Block 5, Garza County, Texas, and this resolution
authorizes the Mayor to sign the permit with them. The
City is to be paid $1,000 per mile; for crossing

approximately 1.8 miles, the total compensation will be
$1,800. Staff recommended approval of the permit as
long as no opinion prohibiting seismic surveys is
received from the Estate's Attorney.

According to Staff memo, earlier this year, CenterCorp
approached a number of downtown businesses and agencies
about the possibility of providing exterior lighting on
facilities in the downtown area. Interest was
expressed in lighting the City Hall building, Municipal
Square and the Mahon Library, but bids for all three
projects exceed the $50,000 budget amount.
This Change Order will reduce the $53,337 Contract with
Row -Wall Electric, Inc. from $53,337 to $47,625, and
will eliminate the Mahon Library project. That project
is substantially less expensive than the other two
since it has far less concrete adjacent to the building
and therefore require less expensive trenching and
boring. Staff indicated that work on the Mahon Library
project is anticipated for a future date.
Costs for the materials associated with the proposed
projects will exceed the $50,000 project cost, but will
be covered through deferred projects. Staff hopes to
complete the projects in late November.
