construction costs, and this $50,000 will be matched by
both the City of Lubbock and Saint Mary of the Plains
Hospital.
Consider Certificates of Appreciation honoring Lieu-
tenant Alan Breazeale, Firefighter Doug Cunningham, and
Firefighter Mark Baker.
On November 1, 1984, Fire Station #9 (50th and Wayne)
received a call for assistance for a "man trapped in
mud" at 4718 Slide Road. Upon arrival, Firefighters
found Richard McKinley at the bottom of a 20' deep
by 4' wide by 8' long hole. Mr. McKinley was
in an upright position buried in mud to his shoulders.
Anyone in the hole with Mr. McKinley would have been
buried alive if the walls had given way. Although
shoring was ordered by radio, suitability and arrival
time of the shoring was uncertain. Lieutenant
Breazeale and Firefighter Cunningham were the first to
enter the hole, relieving two construction workers who
were attempting to dig Mr. McKinley out. After a
working platform was established and a ladder was
lowered into the hole, Firefighter Baker entered to
assist.

During the I984-85 Budget hearing, the City CUUDCi|
received Citizen requests to install d playground On
Bill and Ann Miller Park (74th and Memphis), and to
develop the park site in the Meadows Addition (9ISt and
Chicago). The Staff was instructed to discuss this
matter with the Parks and Recreation Board and to bring
back recommendations to the City Council. Since that
time, the Staff formulated cost estimates for these
f0prOV0OeDts and prepared a method to fund these
projects.
The total estimated project cost for development Of the
Meadows park site is $193,000. 8fOC2 the total work
could not be dcCNN»JiShed in 1984-85, the project was
divided into two phases. Phase I includes Contract
administration @ $5,000, contracted earthwork
@ $18,000, and the irrigation System @ $80,000, for a
total Of $103,000. Phase II, which would include O
playground, picnic units, volleyball/ basketball
courts, and landscaping, would cost $90,000. The CO3t
of constructing a playground on Bill and Ann Miller
Park is $30,000.
TO fund the Miller Park Playground and Phase I develop-
ment of the Meadows Site, the Staff has identified d
total Of $91,123 in existing work orders that have been
completed, and that d0 not require these remaining
funds. Exhibit «Aw to the Resolution outlines these
particular work Orders and the funds remaining. TO
addition to these funds, an additional *41,877 could be
reallocated from Mackenzie Parkway Project. The State
Highway Department has indicated an interest in
providing both engineering and construction of this
r0ddway.
The Staff recommended that $91,123 from various
completed work orders pTU3 $41,877 from the Mackenzie
Parkway Project be reallocated to fund the Meadows/
Miller improvements. For 1985-86, the Council could
consider an additional $90,000 to fund Phase II Of the
Meadows development. The Staff also recommended that
$42,000 be restored to the Mackenzie Parkway Project SO
that curb and gutters could be partially installed if
the Highway Department is able to provide engineering
and ConStrUCtƒOD services.

Southwestern Public Service Company filed d Notice of
Intent to Change Rates with the City Secretary November
h, 1984, in Order to offer d "church rate" for its
customers. Normally, changes cannot be scheduled to
take effect l9SS than 35 days after the Notice is filed
with the regulatory authority, but in this Cd3e 8P3 had
requested permission to institute the rate on December
l, 1984. The 35-day period would provide an effective
date of December Il, 1984. Due to the holiday Council
schedule, the O8Xt COUDCfl meeting is Set for December
13, 1984, which is later than the requested effective
date. Failure to take some action by December lI,
1984, would result in the change going into effect
automatically.
Section 42 of V.A.T.3., Art. I446C, provides that the
change may take effect in less than 35 days "for QOOd
cause ShOwD, if the change is not d "major change."
Since this rate change will result in a decrease in
revenues, rather than an increase, it is not O major
change and therefore may go into effect e-v if the
Council approves the request. SPS also stated that if
the Council did not approve this change to g0 into
effect OO December I, 1484, they would like an effec-
tive date of January l, 1485.
The other UotiOD Of the Council was to suspend the
effective date for Up to 90 days and order d Public
Hearing Vp0O the reasonableness Of the proposed rate.
The Council could d0 this under its own 00ti0O under

days a year.
The current Taxicab and Limousine Ordinance in Section
27-5 limits the transfer of passengers for remuneration
to only valid City taxicab service or limousine service
permittees. The revised Ordinance would add charter
bus service to those permitted vehicles for hire to
legally serve the Airport. The revisions to the
Ordinance include Section 27-5(a), (b), (c), which
would include wording which would state that charter
franchise bus services are also authorized to serve the
International Airport.
If the City Council approves the provisions of the
Ordinance, Mr. Violett would be asked to submit his
request for a franchise for bus service to Staff. The
bus service franchise outlines the areas of safety,
insurance, fee structure, and other areas that should
be considered.
