Motion carried: 7 Yeas; 0 Nays (FIRST READING) Consider request of Bill Cox for site plan approval under Zone Case #2104-B for Lots 33-35, Woodland Park Addition. Bill Cox presented the above mentioned site plan for Council approval. Mr. Cox cited the problem develo- pers are having when they begin to develop their property, and upon taking out a building permit, find specific use requirements or special conditions attached to the zoning of which they were unaware. Mr. Cox requested that Staff discuss having a special designation (i.e. C-2C or C-2SP) when conditions are attached to a zone change, so that a developer/buyer would be aware of these conditions before he plans use for the property. Assistant City Manager Jim Bertram indicated that conditions or special uses such as these are noted on the Zone Case Index Map in the Zoning Department, and also, that the owner is notified of same when he receives notification of a zone change, but there may be a breakdown between the buyers/sellers. Mr. Bertram will discuss this with Staff and come back with recommendation to Council. It was the consensus of Council that a policy be drawn whereby City Council review of site plans would be of the entire site under consideration, rather than piecemeal reviews. Council wants to look at the entire zone case, and not just one portion at a time. Jim Bertram is to bring a policy recom- mendation back to Council on this matter, and the one mentioned above on the August 9 City Council agenda. City of Mr. Kenneth Jones (for Woods Metal House) presented a request for zone change to allow moving a Metal Salvage Yard which is being displaced by 1-27, to 2701 Avenue A. Mr. Jones stated that the owners have operated a Metal Salvage Yard at their present location since 1959, and their business is small, with many walk-in customers selling cans and other small metal items. Mr. Jones also stated that the JUL 2 G 1984 51 owners will be good neighbors and will do everything in their power to work with the businesses and resi- dents in that area. They will have a chain link and a screening fence completely around the portion of the property containing the Salvage Yard, and will landscape the northern portion of that property which will not be used as a part of the Salvage Yard. Also, the proponents are willing to do anything else Council may ask of them. Mr. Jones asked that City Council approve this request. Council questioned the proximity of the location to two churches in the immediate area. Pat Houston (the proponent) pointed out the specific locations of the churches as compared to the proposed location for the Metal Salvage Yard. Speaking in opposition to the request were Harold Chatman (2316 Date Street). Mr. Chatman provided a photograph of a Metal Salvage Yard presently located in East Lubbock, a photograph of the Metal Salvage Yard presently owned by the proponents, and also a petition containing 400+ signatures from opponents of this request. Also speaking in opposition to the request were Stephanie Hill (resident of 2712 Cedar); George Woods (resident of 2202 Date Street); W.H. Watson (owner of Watson Food Service, 107 26th Street), and Reverend Stephen Pierson, Pastor of Bethel A.M.E. Church. Motion was made by Councilman Patterson, seconded by Councilwoman Trejo to deny the zone case request. Motion carried: 6 Yeas; 1 Nay --Councilman Brown 84-43A-512-856 (20.) Hold a public hearing for the Grantee Performance Report of the Community Development Block Grant year ending May 31, 1984. Mayor Alan Henry opened the public hearing for the Grantee Performance Report of the CDBG year at 11:30 a.m., at which time he requested that all questions and comments be directed toward the status of current or completed projects, and stated that requests for additional or future projects would be inappropriate. Sandy Ogletree, Community Development Coordinator, gave a slide presentation and a brief narrative of the GPR. Eliseo Solis, who was representing the Cherry Point Neighborhood Association, asked that a comparison be made. between the number of houses demolished and the number of houses being repaired. Also, Mr. Solis questioned the $30,000 expense for the Feasibility Study, and gave the opinion that this kind of expense would, in his opinion, be more appropriate spent helping individuals. Mr. Solis also regis- tered a complaint about the plans to re -brick Broadway. He advocated reactivating the Community Housing Resource Board, and stated that housing is a more pressing issue than beautification and he encouraged the City work with ELNA and Guadalupe Neighborhood Association more. Tavita Dorrow spoke requesting that CDBG funding be spent less for capital projects and more for assisting individuals needing help. She requested that some thought be given to what will happen the those displaced by 1-27 construction, and spoke of the need for more low-cost housing. Ms. Dorrow asked that Council reconsider the decision to re -brick Broadway and also that Council monitor City projects more closely with regard to compliance with Affirma- tive Action Rules. ZONE CASE #2372--Re uest of Thomas Pitts (for Rodeo Center, Inc.) to change a tract of land out of Section 2, Block E-2, City of Lubbock, Lubbock County, Texas from R-1 to A-2 Zoning District (located at 13th Street and Quaker Avenue. Mr. Thomas Pitts (for Rodeo Center, Inc.) asked for a continuance on this item until the second meeting in August, that he may have sufficient time to get better cost estimates. The delay in this has been due to a lack of topographical maps from Texas Tech for the property in question. Now that these maps are available, time is needed to study them and come up with better cost figures. J.D. Richards and Judy Way spoke in opposition to the request for continuance. Motion was made by Councilman Brown, seconded by Councilwoman Trejo, continuing this zone case until August 23, 1984, and instructing that a Master Plan and Certified Engineer's Report be given to Council at that time. R- ublic hearinq to consider an Urban Renewal e for the Memorial Center Complex Project Mayor opened the hearing at 1:35 p.m. and the following people spoke: No one spoke favoring the amended plan. Speaking in opposition was Mr. Lester Shaver who owns property at 4th and L opposes the Urban Renewal Plan Change. He and his partners have bought property at this location, remodeled it and plan to lease it. They do not feel their property should be taken by eminent domain if any of the property the City it is get through this process, will be resold or used for commercial purposes. Mr. Wilson Martin, O.W. Chisum Contractors, opposes the Urban Renewal Plan Change because when he bought the property a year ago in June and subsequently applied for the building permit in December, he was given no information regarding this land being considered for development by the City of Lubbock. Mayor Henry closed the hearing at 1:39 p.m. Councilwoman Baker asked for clarification by City Staff concerning the comments of Mr. Shaver and Mr. Martin. Jim Bertram explained that when these gentlemen were looking at the property with plans to purchase and upgrade it, the City Council had not accepted the final report from the Consultants on the Riverwalk Project. Staff was not in a position to advise citizens against purchase or development of land in this area, because the land was merely under study and if the Riverwalk Plans were deemed to be unfeasible, then property owners whom the City advised against purchasing or developing the property might be disgruntled because they had not gone ahead with their original plans. Mr. Bertram went on to say that the Riverwalk Concept is still un.der study and nothi,ng final or binding has been done regarding this concept. Mr. Bertram explained further that this is an extension of Memorial Civic Center Project, and had there been adequate funding in the Original Plan, property up to the railroad tracks immediately north of the Civic Center and over to Avenue Q would have been included. If the Riverwalk does not come to pass, this land will be cleared and re -developed with uses more compatible with the Civic Center Project, and just because Council amends the Urban Renewal Plan, the property purchased does not have to be sold to Urban Renewal. There will be a hearing at the August 9 City Council Meeting to consider funds for making those acquisitions.
